On 1/23/1999, the plaintiff and James Hannah AKA Super Sports Auto Restorations Inc entered into a contract to repair the plaintiffs 1965 Chevelle Malibu SS. Earlier in January of 1999 the plaintiff had been involved in a car accident, which damaged the Chevelle. Hannah evaluated the vehicle and agreed to perform the repairs for $4906.06. Travelers Insurance issued payment to Hannah in March of 1999.

Plaintiff made numerous requests for the return of his vehicle because Hannah had failed to repair his vehicle. Despite numerous requests for the return of his vehicle, Hannah refused to return it. Plaintiff had also been informed and he alleged that Hannah was concealing the whereabouts of his vehicle.

The present day value of the Chevelle is $15,000. Plaintiff claims Hannah also removed parts from the vehicle thereby exposing the vehicle and its interior to the harsh elements of nature. Pictures have been submitted (taken 5/19/2002) of the car outside in the back of Hannahs business location. Plaintiff has seen his car stored outside on several occasions for months on end.

Mid March plaintiff called Hannah and it was agreed upon that plaintiff could come and see his car on 3/11/2000. Plaintiff and his wife showed up and Hannah stated that his workers had just cleaned the garage so the plaintiff couldnt see his car at this time.

On 4/03/2000, Hannah told plaintiff that the only item remaining was for the front grill to be assembled. On 4/20/2000, plaintiff went to see his car. It was outside in very bad condition. The bumpers had been removed, the grill was not assembled and there was no primer paint on the car. Plaintiff returned later that day to speak with Hannah. Hannah stated that the plaintiff agitated him and Hannah did not want to work on the car any further.

On 6/29/2000, plaintiff was finally able to get an appointment with Hannah so he could pick up his car. Hannah said plaintiff could not have the car until additional repairs were done. Hannah also stated that plaintiff couldnt get his car back until their attorneys came to an agreement. Plaintiff noticed at this time that the repairs that the insurance company had originally paid for werent even done. Plaintiff claims his car was in worse condition than before it went in.

Hannah claims he made additional repairs and plaintiff owes him $1,400. Plaintiff never authorized any additional repairs.

Case went to arbitration. Outcome unknown.

James Hannah AKA Super Sports Auto Restorations Inc AKA Supersport Restoration-Collision lost his business license in May of 2000. The license became inactive 5/31/2000 due to delinquent tax payments. To this date Hannah owes $18,214.88 in back taxes. He is still operating his business without an active business license.
