I was driving down the interstate just getting off the onramp, when I hit a bump or new pavement over old. When my seat went all the way up then slammed down to the floor with alot of force.

Contacted dispatch and told her I hurt my back felt like I jarred my back, which she said can you make delivery. I said yes but I was going to rest first if i couldn't I'd call.

Being in a lot of pain I delivered load which I proceeded to pull my should out of socket from tring to move tandems on trailer. Then went to truckstop and laid down for couple days.

Finally I went to emergency room took x-rays gave me tylenol for pain.

Dispatch had no idea what she was doing, she just pretty much kicked me out of truck and threw me on a bus (that did my back alot of good). Point being I lost everything that was on my truck clothes, cb, tv, movies and loadlocks. She told me the recovery company was going to empty my truck and ship it and told the recovery company if I didn't get it out throw it away.

That hurt but it was just stuff in a truck. What hurt the most was my company the one that says your part of the family lied on the workmans comp form and I was denied benefits from arkansas. Told them I reached up to turn turn signal on and pulled muscle in back. I could handle if they wrote the truth then denied there's a process, but to lie I've been not workin for almost 2 years and on last leg, have workmans comp lawyer on it.

They treated me like I just got out of truck and said send me home. (Ya know they have the b__s to call me up atleast 2-3 times a month and ask me if I want to come back to work. Well I can't they haven't released me yet won't even get job at mcdonalds or anywhere else for that matter.

Gary, "at will" employment has nothing to do with workman's comp.

Gary, You need to file a complaint with the labor board in TX and the USDOL. Also file a complaint for your injury with the USDOT/FMCSA as it will reflect on JB Hunt's safety record and they will assist you too. You should seek a personal injury lawyer who works on contingency. Find one who specializes in WC cases. Get everything in writing. Stay off the phone. Good luck!

What type of lawyer was it that you had to hire for this? Since we're dealing with ERISA. I am in Texas and its an at will state, workers comp is dealt by JB and not actually workers comp for Texas. This whole thing about no benefits is really F***ed up, not being able to have any wages coming in until discharged by a doctor of the company sucks too. I just submitted a report and would like for you to read it, I'm out of san antonio and too bad this d**n thing won't let us give out our private information to contact one another, Dave.
