I'm the defendant of this case. After I read what CHARLES posted here, I had no alternative then to post this rebuttal... I want to go on record that CHARLES is a lier. He exaggerates the truth, twists the facts, and simply tell lies to benefit his case. Even though the judgment was for the plaintiff as stated, the original award of $4,000 was reduced to $3,000 at the second hearing. Here's the reason... I consulted for CHARLES for six weeks, of which CHARLES told the judge it was a few days. I presented 32 pages of dated email correspondence between CHARLES and myself. I called CHARLES a "blatant lier" in front of the judge. Funny thing, CHARLES did not object, but looked somewhat embarrassed. As the case continued, CHARLES stated to the judge that since he failed to purchase a pool route, my due diligence had not been fulfilled. He requested the Contract, which I provided the judge, be null and void. Since I did not have a cancellation policy (my own attorney pointed that out later!) in my contact signed by the plaintiff, the judge ruled in the plaintiffs favor, but with exception. Read on... Do I agree with the judgement? No. But the fact is the judge did validate my business operation by stating that all my business licenses were in order, even though CHARLES posted on another site I wasn't, and the service I provided CHARLES did have a monetary value, though CHARLES said it didn't. The judge did award me $1,000 of the original $4,000. CHARLES is a lier. The plaintiff also fails to tell you in the previous posting that he had solicited me, not the other way around. I don't offer "due diligence" as a service. Why would I agree to spend weeks with a client with no guarantee I would get paid? Pool routes brokers routinely earn approx. 20%, my fee was only $4,000. No where on my website (www.poolsuccess.com) do I offer anything other than a training course. He found my site and he emailed me. When he offered me $4,000 for my time to assist him in evaluating potential pool routes, I agreed. If he did 'fire" me as he posts, then why hasn't he purchased a pool route, nor looking any further at buying a pool route? Here's the answer... Here's where things went wrong... after working with CHARLES for several weeks, I realized he didn't have a realistic grasp of this kind of business. As far as a service based business, this guy didn't understand even the basic principles. To protect my client, I suggested he sit down and really understand what it means to invest his stated $500,00 to $1m because there does exist a high risk of losing his money. He eventually believed me, and demanded his money back, promising me to pay me is he reconsidered buying a pool route someday. Huh? I invested six weeks into this guy, and he wants a refund? I saved him at least $496,000. He should be grateful. CHARLES is a lier. As for CHARLES' witnesses, he includes the name of a pool route broker. I think that was brilliant of CHARLES to list one of my biggest competitors. I don't figure my competitor will say good things about me, so this is a sure thing for CHARLES. I also don't believe Charles Baird agreed to be mentioned on this post. I feel to this day that Charles Baird, of Pool Route Sales, provides a valuable service to the pool service industry and to individuals. I believe he has a high success rate, and does an outstanding job selling pool routes for top dollar. But for those who choose not to purchase a pool route, I offer an alternative... starting a pool route from scratch by following a proven system. It's that simple. The truth of the matter is that I was never properly served, thus I did not have the opportunity to appear in court. So the case was never heard, only the award was given, but... Upon finding out about the judgment, I immediately drove to Henderson, Nevada (I reside in San Diego county. Pool Success is a Nevada corporation and training is held in Las Vegas each month.) and personally asked the judge to rehear the court case since I was never served, along with providing several other valid reasons. The judge agreed. Note that I did not "appeal" the case, as CHARLES states. If I had appealed, I'd have to pay a security bond, which I was not required to do. CHARLES is a lier. Another consideration... if the judge had agreed to all the negative statements CHARLES claimed to have made in the first trial, why would the judge have agreed to rehear my case? the reason is the award was automatically given to the plaintiff without being heard, as is common in small claims court. Did I say, "small claims court"? That's right... by CHARLES referring to it as "Justice Court", CHARLES would have you believe that the trial was in some criminal court, not small claims court. Not the case. CHARLES is a lier. I also noticed that my wife, Christine, constantly is referred to as part of this defamation going on in this post. Her name never appeared on the small claims suit, nor did she appear in court with me. I brought with me my son, Justin, to witness his father face his accuser and never back down from a fight. CHARLES chose to bring his mother. I believe she is the money train in which he gets his money to "play business man". Doctor? He's not an M.D (medical doctor), but a N.D. with a degree in raw foods. Does that make him a good guy? He's the owner of EJUVA intestinal cleanse, which I believe is a multi level, MLM Amway kind of business. So why is it so important for a guy who brags to me he lives in a million dollar estate (I live in a townhouse), and drives a "$200,000 Lambo", short for a very expensive italian made car (I choose to drive my dependable, paid for Honda) to be obsessed with a few thousand dollars? Because I don't think it's his money! He did email me awhile back and said if I would pay him the $4,000, not the $3,000 awarded, he wouldn't post anything about me. I told him to "get in line", that it's blackmail, and I simply don't deal with liers. but I did promise him "I'd make him famous". And what is CHARLES famous for? That CHARLES is a lier. I'd like to also state the reason CHARLES never states his full name on the post, is to stay clear of the Google Search Engines. He's clever enough to list my name, my training event business name, and my own personal pool service name, as a means to defame me on the internet. I promised CHARLES if he played this game, so would I. But I don't need to lie, or exaggerate the facts of my case... just state them. What CHARLES did to my reputation is horrible, reckless and without conscience. I wouldn't want to wish what he did to me, my reputation, and my family on my worse enemy (or competitor). The internet is a powerful tool, and in the hands of someone with evil intent, it's even more powerful. Congratulations CHARLES PARTITO, you've accomplished what you threatened you would do if I didn't "roll over and play dead".
