On Friday, January 16, 2009 I receive a Judgement of Default at my PO Box on a case that I did not even know existed. HUH??? I checked out the AZ Superior Court website under Judicial Cases and found that a lawsuit was filed against me on May 9, 2008 for debt collections. Say what? A lawsuit. I was never served by a process server nor did I receive any notification in the mail.

When I contacted Jarold Kapan's office I called under false pretense saying that I had received a settlement letter. The "attorney" or debt collector laughed when I told him the amount that I "remembered" the lettering stated as a settlement. He said that no way no how would Midland Funding LLC settle for that small amount. The debt was for $3600 plus and then add attorney fees $1000 plus. He would be willing to settle for 70% of the debt and accept a minimum monthly payment of $100.00. That is CRAZY.

The credit card debt is from First Consumers from 2002/03 and was charged off and sold to Midland Funding. The collector said that Midland was actually the company that funded my credit card and would have been on the application I completed. That is total BS. I contacted another attorney who said that they were familar with Jarold Kapan's office...found it very strange that a default judgement had been sent to my PO Box and would have no problems getting that overturned. The problem now was the $2000 retainer that they are wanting because the case was not so cut and dry. Apparently there are 19 circuit court judges in AZ. Only three have law degrees leaving the remaining 16 to go against the law and siding with the Jarold Kapan.

This is such a crock. The statues of limitation is fast approaching on this credit card debt. I make too much money for legal assistance and I certainly do not have $2000 let alone $4600 for the debt. If I did....I would not have a bad debt!!! Any assistance on how to fight this judgement single handed would be appreciated.

FINALLY! Midland has agreed to "Dismiss Case With Prejudice" - Will wonders never cease. Of course it cost me $1500 in legal representation to get it done. I should get the court doc any day now with the Judge's decision to grant this motion.
