Just take a look at the dumb laws website, it is very confusing. Also unless, she has the money to up and move her and her children very far away, I doubt that she has a choice. I had a friend who's father had walked out on her mother when she was 4, the state of NJ finally gave her mother a divorce due to abandonment, (meaning he can or will not sign) when my friend was 20. Because they wouldn't even consider it until over 16 years had passed. (and her mother had to prove that she had tried on her own to locate him, to no avail.) That's just how it is in the that area.

That you are NOT able to get a divorce in the state of New York, in four years time, without the consent of your husband? If so, maybe you should consider moving to a more friendly state for a few months, get your divorce and then go back home. If you CAN get a divorce from your husband, without his consent, what's holding things up? Why haven't you pursued this and moved on? Sorry girl, 4 years is a long time to hang on waiting for someone else to take action, even with kids. There's got to be more to this story......
