Nutshell: Kay personnel harassed me in store, via Kay.com 1-800, via email, via Sterling Jewelers, and it goes on, fully knowing that I was at the time post-op and handicapped with dominant hand, and that husband was in Iraq.

Where to begin - In-store: Took wedding set to local Kay store (where my husband purchased set last year) to get saudered. Had extensive hand surgery on dominant hand in Jan 08, same time husband deployed to Iraq. Took rings to get sautered Feb 08, while he was gone.

Was assured by sales rep named Ryan, with whom we had worked with for two years, rings would meet my expectations and would be ready 3/06/08. Call first to see if they were ready; was told they were, so went to store in mall. Did not recognize any sales rep (or whatever they call themselves) and took note that two young males were loitering in the store (didn't fit environment - believe at least one to be boyfriend/acquaintance of young "rep" working that evening). Normal store manager was out on spring break.

When approached by "rep," told them I was there to pick up ring. They asked for ID and receipt, which I expected, at the minimum. However, when they saw that it was taking a while for me to get it out of my wallet (impaired right hand/thumb), one "rep" rushed me and instead made me verbally give name and address. They gave me what I thought was my ring without proof of ID/receipt. When they asked if it met my expectations, I said "no," at which time the reps accosted me, and the young girl's acquaintance put his elbow on top of the counter and stared at me to intimidate me. I was so scared and upset that I left with a screwed-up ring and in fear that one/both men loitering would follow me to my car.

**Nargis, sr. rep, told me that it didn't matter if my wedding set was messed up; she'd just "get me a new one." My husband, who is still not back and here to defend his purchase, bought the initial ring and then bands for me and they were all blessed by our priest at our wedding last year. She unabashedly trashed it's sentimental worth, as if it had come out of a gum machine.

Reported incident same night to Kay.com; they never called back. Have filed BBB claim and have contacted Sterling Jewelers District Manager (Kay holding company) 3 times with no response. Took ring back to store with normal store manager's (Mike) assurance it would be fixed to spec and be on my finger 4/15/08. Got call on 4/15/08 from his rep - never made it to store but would definitely be at store 4/17. Store manager called today to inform me, that "oops!" ring didn't make it and it was UPS's fault. After drilling him for a few minutes, he admitted it was the Sterling repair shop that "forgot" to put set in UPS box for 4/15 date; today he claims it's UPS's fault.

Given all of the broken service plan agreements, threats, verbal harassment/abuse from female employees both in-store/via Kay.com, lies, empty promises, etc., I don't know if I should even attempt to go pick up what they claim to be my "original" set, at least until my husband gets back from his deployment. I still have my BBB complaint open, but doesn't seem to matter. Looking to sue for fraud, etc.

Sorry, but you should have never signed for the ring in the first place if you were not satisfied.  You sound older and should have more common sense than that.  You kind of make me sick, actually.  "Two young males loitering in the store...Didn't fit environment.." This sounds like profiling, and you should be ashamed.  WHY didn't they fit the environment of a jewelry store?  Because they were young?  Maybe wore baggy clothes?  Were they a MINORITY? 

The reps "accosted" you? Please. Your a drama queen.  You have no clue what accosted even means.  "Put his elbow on the table and stared at you to intimidate you?" I personally think you are way out of touch with reality and second, are making up excuses as to why you are indeed at fault.  When it becomes a matter of he said, she said, the only thing that you can refer back to are the facts, in this case, documents and signatures.  If I were a lawyer for Kays, it would be open and shut.  Is this your signature stating that this piece of jewelry is to your satisfaction?  Yes? Done.

You know, 99% of your post has to do with everything BUT the ring. Your problems, your husband's problems, who said what, who did what, who went with whom, who didn't call whom, who did or didn't call on this or that date. WHO CARES? Just do us a favor and stick to the problem of the ring. In your first post, out of seven paragraphs, only one sentence deals with the actual problem, the ring. I hate to use the term but skip the drama. I'm always suspect when the last words are: "Looking to sue for fraud". Usually people looking for a meal ticket.

Going to have to get lawyer; dollar value exceeds small claims. BBB no help; kay/kay.com/sterling customer service mgr didn't call me until I filed complaint on this site, even though I left her a message on 3/6/08. She badgered me the entire phone call, asking me what was wrong, and admitted that she had no documentation (receipts/repair slips, etc) except for the BBB complaints I had filed, which she drilled me on. Additionally, in her BBB rebuttal, she falsely and intentionally misrepresented our phone conversation on 4/25/08, and said that I refused additional customer service. Never said it, and wish I had recorded all conversations. Been repeatedly called a liar by company, when all I want from them is to be accountable for damage, apologize, and deliver my wedding set back to us in the state in which it was delivered. Will post all emails shortly.

NOTE: I DID NOT insert the "BBB" hyperlinks in my message. Don't know how they got there. Went on 4/20/08 to once AGAIN pick up my wedding set. Since my husband is still in Iraq, one of his military peers/friend accompanied me. I was so upset prior to going to the store again I got sick. I just cannot handle how the mrg/store employees/"cust. svc" people verbally accost me any more. When the mgr presented me with my ring, it was not repaired properly. When I told him so, he lied and said that his store didn't repair a certain type of defects. HE WROTE these issues down on the repair receipt from 4/6/08!!! When I showed it to him, he started yelling at me in the store, in front of my husband's friend. I asked to compare my ring to the same one in his case, put them side by side, and was appalled to see how much damage the repair shop had done to the ring. After several verbal bouts (the mgr would NOT accept responsibility for ANYTHING, which appalled me and my husband's friend), my friend suggested that I let them "repair" it again and that my husband pick it up when he gets back from Iraq. It just keeps getting worse.
