First of all, I have no knowledge about the quality of their pools.  This complaint is based on deceptive and misleading sales practices (what is commonly referred to as used car sales tactics).  I was helped by reports on this website and some others that were almost identical to what I had experienced.

My wife and I were looking into getting a pool.  We had a someone come out to quote.  My wife and I both felt that we needed a shower after feeling disgusted about the presentation we had been given.  I didn't realize beforehand that their pools go for 20 grand plus (yes, for an above ground pool).  After a very theatrical performance (extremely loud conversation on the phone with the home office), discounts were given for anything and everything.  Fine, still way too expensive.

Against my better judegement, I signed paperwork thinking it was for a quote and to investigate financing.  I was assured 20 times that nothing would happen until either financing was obtained or payment was made.  It was written into what I thought was an estimate that I could decline if I didn't like the financing offered. 

First of all - this is not an estimate, it is an offer from you to buy a pool!  If they accept (which of course they will) you are on the hook for 15% (or about 3 grand) even though nothing has happened.

Second - the statement about cancelling if you don't like the financing means nothing.  You don't have to have a reason to cancel and it doesn't change the requirement on how to cancel.  You have to cancel in writing within 3 business days!!! Despite the salesman's insistance that there is no obligation, there really is.  This part of the contract was folded over and hidden from us during the sales pitch.  I don't know about the legalities of this, but it certainly is not very honest. 

Third - the salesman asked for gas money!!! Unbelievable.  This is from a legitimate company selling 20 thousand dollar pools?  I have read other reports in which this has occurred - not an isolated incident.

Like I said in the beginning, I don't know about the quality of their pools, but I certainly can't trust a company that has to resort to these misleading tactics to gain business.  I was awakened by other reports to reread the fine print and send in my written cancellation.  If you want to do legitimate business with them, that is up to you, I just don't want to see someone get tricked into doing business with them.

Kayak Pools Midwest would like to apologize for any misunderstanding that may have occurred. If you felt so disgusted and appalled by our sales person or our organization, why in the world would you sign anything? We have on file a very clear signature of you purchasing a pool from us. How could you not have any idea on the quality of our pool when we physically brought in actual components of the pool and let you touch and feel them? I have included the verbiage right above where you signed our contract and the line below it is where your signature goes.

 

AGREEMENT: You agree to be bound by the provisions of this agreement, including those on the reverse side.

By signing this agreement, you each acknowledge receipt of a completely filled out copy of this agreement, two completed copies of this notice of cancellation, and

confirm that you have been orally informed of your right to cancel.

We also left a copy of the contract with you so not sure what you are referencing that it was "folded back" Would love to see other reports where one of our sales consultants asked for gas money. Please forward to Kayak Pools Midwest. ATTN: President

Many times we allow a customer to cancel their pool order weeks later or even months later if the circumstances warrant it but if someone tries to mislead us or is dishonest, we do play hardball. Are you by chance a Patriots fan?

We pride ourselves in business ethics and take all discrepancies seriously and do whatever it takes to make our customers completely satisfied.
