Hello, My first experience on eBay has been a costly one. According to a Postal Inspector, it's called Bait & Switch. A small company, Deja-Vu Gallery of St. Clair, MO, that deals in old housewares and furniture had up for auction a six foot tall throne chair. This throne was represented as being in excellent condition, and probably was. At the end of the auction, I came in as the second-highest bidder @ $960.
A day later, the owner of Deja-Vu Gallery, Kevin Kruse, emailed me that he had a duplicate throne that I may purchase for my bid price, $960., plus shipping of $188. As an interesting sidepoint, eBay now forbids this back-door selling pratice, because the seller makes an endrun around the eBay fees, plus it's a safter way for a seller to conduct a ripoff without having to worry about running afowl of eBay.
The throne that I received from Kevin Kruse was defective. The throne previosly had lost it's crown and was given a replacement crown. The crown does not either match or mesh with the original section of the throne. The defect is very noticable, and friends have noticed it.
The crown is the back top 1 foot section of the throne. These thrones are hand carved and there is no two exactly alike. So, when a throne gets damaged, there is no such thing as the perfect replacement part. A perfect throne sells for about $1000., and a repaired thrones are not as popular, and sell for under $500.
I contacted Kruse, he played dumb. I still have the emails showing him play dumb. Kruse lends himself out to be sort of an authority in his line of business, but he stll played dumb with me. Looking over the emails that Kruse sent me, he was silent about this throne being damaged. Because of Kruse's silence, he gave me the impression that I was buying a throne in excellent condition, as featured in that auction. For what Kruse charged me, I should had received an excellent throne.
A Postal Inspector told me that I was a victim of a Bait & Switch. Kruse gave me two inferior options: (1) keep the throne and receive a $200 rebate (2) return the throne for a full refund of $960., but I am responsible to pay shipping in both directions which would be almost $400 out of my pocket. I've been to two Better Business Bureaus, the Attorney General of Missouri and the Postal Inspector. This was 18 months of wasted time and effort.
Kruse complained that he made me the offers without me providing proof of my dissatisfaction. I maintained all along that Kruse sold me his problem, for whatever photos could be taken, the images were aleady in Kruse's mind's eye. When Kruse was presented with photos, showing the defect, he resented that all the more. So far, none of Kruse's replies had focused on why I did not get what I paid for and how to fairly settle this, without it blatantly favoring him. Thank you. Michael
