I retained the services of Michael Dyer back in December 2009 to represent me for foreclosure defense & bankruptcy.  Who I actually spoke to at the office was Adam Shepherd who was always the gate keeper to Mr. Dyer even though I requested several times to meet the person who was suppose to be representing me.   I paid Mr. Dyer a total of $2,500.00 for this service.  I also retained Mr. Dyer's service (via Adam Shepherd again) to file a non contested divorce; that was another nightmare.  After losing my papework and check and several months later; he did not even bother to show up to the hearing.  I had to call his offices to find out who would be representing me at my divorce hearing.  Finally over a 1 year later; my foreclosure is over and my home is saved it was time to file for my BK.   Mr. Dyer told me that he would file my BK for a chapter 7 once my 2nd mortgage modified my loan.  When I informed Mr. Dyer and his processor Louise Hurwitz with Accurate Bankruptcy Petitions that Bank of America who is the servicer of my 2nd mortgage would not modify my loan; their suggestion was to release the property; they did not recommend a Chapter 13 because the process is long and I will be at the mercy of a trustee.  I then sought the advice of  an attorney who specialize in bankruptcy and he informed me that based upon my income and expenses; I definitely qualify for a Chapter 13 and I will be able to keep my house. 

I spoke with Mr. Dyer on 6/1/11 and explained what I was told by the other bankruptcy attorney and requested my retainer fee of $1,500.00 of the $2,500.00 I paid him and he refused.  He did not offer to discuss filing a Chapter 13 to keep my home.  He just wished me luck and sent me an email saying that he would not refund my money and that he has terminated our relationship based on our conversation.  At no time did I terminate his services.  I would think a professional would do what is in the best interest of the client and in this case is filing a Chpt. 13. 

Since I have retained his firm's services; it has been difficult with his office losing checks and documents during the process.  Mr. Dyer is clearly not qualified or well versed in the bankruptcy laws when his only advice is to give up my house because Chapter 7 is easier to do than Chapter 13 because he is too busy or not qualified.  I do not think that I should have to suffer because of his lack of knowledge.  If he was not qualified; he should not have advertised his services as such.  After retaining his services; I have seen complaints through the Attorney General against Mr. Dyer and have personal knowledge of a former client.  The turn over at his firm is high and I can see why he cant keep qualified people who know what they are doing.  Do your homework before retaining his services.
