My wallet was stolen at a party in 2009 , three months later I'm getting these calls saying that i bought some magazines which of course i didn't buy. i got a call about 2weeks after that saying its under my name untill december of 2010 i didnt have a job and i kept telling them i did not buy those magazines. i thought since its was under my name i had to pay, after i give them my information they said i can file a report if i didn't purchase those magazines. i told them i don't know when i can report it in but ill do it before January 15 of 2011.

That was the end of that conversation. i recently got a check from the job i have now and i tried to cash it through the bank and Luebke, baker associates took the whole check and locked my account. i want this to end as soon as possible!!! I DID NOT BUY THEM I WANT MY MONEY BACK AS SOON AS POSSIBLE

I worked for this company several years ago when they were in Peoria, IL. Their magazine collections makes them quite a bit of money but they honestly have no recourse in making someone pay. They little to no information on the person who owes for the magazines. They don't even have SSN's to match to the names for the Magazine orders. All they have are names addresses and phone numbers. They did employee skip tracers and also used professional skip tracing services in order to locate people they couldn't find.

With that said it is hard to tell if they had the right person when they called you or not. Could have been someone else living near you with the same name as yours.

Honestly there isn't much you can do at this point except get an attorney. You should have sent them a Cease and Desist letter requesting that they stop all collection efforts. You also should have repeatedly told them in the first phone conversation that you dispute this debt and request proof. If they tried to argue further and if they made any mention of possibly suing you over the Magazine debt they would have been in violation of Federal Law and that would have been an easy $1000 in your pocket minus your attorney's 33%.

***Also if they mentioned anything about your "Credit File" and this debt that would be illegal as well. They are not allowed to place Magazine debts that they have no information on into your credit report.

I would suggest speaking with an attorney and seeing if it is monetarily in your benefit to pursue any action against them.

Now for the part that you seem confused about.

You stated in your post that you thought you had to pay since it was in your name and you gave them your "information". By information I assume you mean Banking information. They took this and were probably pretty clear about how much and when they were taking out the money. They most likely didn't lock your account. What they did was send in the electronic payment that you agreed to into your bank and that's where your money went. If your bank received that before you had the money in there is was considered a bounced check so you probably had a fee for that as well.

They used too and probably still do like to run the payments earlier than they are supposed to. This is also illegal.
