I purchased a vehicle at Lupient Kia in Minneapolis 3 months ago from out of state with milage in the late 60k range. When I arrived it had body damage that I was not informed of. On the drive home the car had very loud wind noise coming from a bad windshield replacement. Come to find out now, the car also has a bad piston and the short block needs to be replaced.

Now I need a new motor in a car I just purchased 3 months ago. Installation of a new motor would cost me half what the vehicle is worth. I was told by a salesman to expect a call from the manager, haven't heard a word yet.

Typically, a car with this low of milage doesn't have nearly any of these problems. It's not even due for a timing belt yet. I couldn't have even purchased a warranty for it because I'm from out of state and I realize there are shady car dealerships out there, but I expected more from an a legitimate dealer. The car wasn't even detailed for me when I arrived but due to the circumstances of it being a difficult car to find, and the fact that I was planning a long road trip and had already flown from Seattle to pick it up, I bought it anyway.

Just a terrible experience really, I love the car and am forced to keep it because I can't afford to pay off the 10k thats left on the loan. I wouldn't want to pawn it off on some other poor sap either. I have tried contacting Lupient Kia to ask for financial assistance only on the new short block, I know enough about mechanics to put the short block in myself. Could save 3k-4k with my own labor, I don't think I'm asking much.

Any help would be much appreciated.

You are very right that the link I provided was incorrect. And also correct that a car can be sold "as-is". Except in the State of Minnesota where a vehicle sold by dealer with less than 75,000 miles comes with a warranty.  Whether or not we are a Motor Trend certified dealer or not is certainly not the point here. The point is this.   A customer contacts us about a vehicle he wants to purchase. We hold the vehicle for the customer for a couple of weeks until he can travel to us and pick it up. Customer knows full well the risks involved in purchasing a used vehicle which is 6 model years old and has 70,000 miles. Customer declines an extended warranty that would help alleviate most of those risks. Customer drives the vehicle back home to Washington and has the vehicle for 3 months and 8,000 miles before we even hear a word from him. When we do hear a word from him, it is that we "sold him a bad car and we better take care of him". And here we thought it was his car, and he's acting like it's still ours. Then when he doesn't get a call right away(over a holiday weekend), he spreads libel all over the internet.   FLYNRIDER, Do you need a microscope to understand what I have said here??

    Your post was very enlightening.   It points out to people that they have to pick your sentences apart with a microscope to get at the truth.   I think that most people reading your initial response would have said that you were implying that you were a Motor Trend Certified dealer.   Very well done.  I now have no question that you've been selling cars for over 30 years.  You are quite adept at saying one thing that really means something else.   I wonder how Motor Trend would feel about the casual use of the name of their program by dealers who are not part of their program?

   You're correct that their are 5 Motor Trend Certified dealers in MN, and that you're not one of them (which was really my point). 
 
   I'm wondering if you are on the same Internet as the rest of us due to the FTC link you posted.  You claim it tells about the FTC mandated warranty, but it is simply a page about the Buyer's Guide requirement, which, by the way, says you can sell the car "as-is" with no implied warranty.   I've also been in the car biz and everybody knows this.   Why don't you?

I am actually in the Used Car business and have been for nearly 30 years. I never said we were a Motor Trend certified dealer, I said that we use an inspection form designed by Easycare and Motor Trend for the Motor Trend certified program. As for your statement that "Motor Trend Certified program lists no participating dealers in Minnesota', just Google Motor Trend Certified and once you get to the site click on Minnesota. (Hint: it's in the upper midwest area of the US) You'll find 5 of them listed.     As for the FTC warranty on used vehicles I'll even include the link for you  http://www.ftc.gov/bcp/edu/pubs/consumer/alerts/alt035.shtm.    It honestly didn't take me much time to find this information. Probably about as much time as it took for you to post.

Motor Trend Certified program lists no participating dealers in Minnesota. 

"   This customer was given the opportunity to purchase an extended service plan that would be valid anywhere. He declined that option and went with the 30 day/1000 mile warranty as mandated by the FTC."

The FTC does not mandate any warranty on used car sales.   Are you sure you're in the car business?

I bought the car 3 months ago, not 5.  2 weeks of which were spent driving the car home.

The shop I took my vehicle to for the compression test has 5 star reviews across the board and specializes in Subarus:

Your dealership has 1 star reviews as previously posted, I will let the readers decide for themselves.

I asked for a new shortblock that I could install myself, it costs $2,000 direct from Subaru That is less than a 3rd of the cost I was quoted at this shop installed. They quoted me $6-7,000, I would call that more than a compromise.

You are very right. When a buyer can call a dealership 5 months and 8000 miles after they purchase a 6 year old used car with over 70,000 miles on it that came with a 30 day 1000 mile warranty, lie about not knowing the condition of the car when they purchased it, Say there is a problem with the car, not because it stopped running well, but because some mechanic who is probably trying to sell him something told him it is a ticking time bomb, threaten the dealer that they will use their professional knowledge of Internet marketing to ruin their reputation, if they won't send him $2000, and that is not some sort of crime. There is something really wrong here.

I flew about 5,000 miles to drive this car home to Seattle on a road trip vacation. I couldn't have got it home for less than that.

It is extremely obvious that the only positive reviews on these sites are from your own dealership.

I was told the warranty would not cover repairs in my state.

I finally received an email reply today from the manager Skip Cady, now five days after I was told I'd receive a call, reciting the same loopholes all shady dealers recite.

He told me that my reviews are slander, well if this is slander than so are the reviews from every other person I've linked in this rebuttal and every other person that uses this site. If there are that many people upset enough to slander Lupient Kia, maybe you should consider a change in business practices because obviously something is very wrong.

One thing that this person failed to mention is that he has put 8,000 miles on the vehicle since his purchase. We all know that anything can happen to a vehicle in 8,000 miles. Our inspection for our used vehicles is an industry standard inspection used by the finest dealers around. It is an inspection that was designed by Motor Trend and Easycare for use in their Motor Trend Certified program. I believe in the inspection and use it everyday to ensure our customers get a good solid reliable used vehicle. I do not know of any dealers that use a compression test as part of their used vehicle inspection.    This customer was given the opportunity to purchase an extended service plan that would be valid anywhere. He declined that option and went with the 30 day/1000 mile warranty as mandated by the FTC. Our goal is to provide our customers with a good reliable vehicle at a fair price. We have been serving customers in the Upper Midwest for over 40 years and continue to do so to this day.
