After a week of moving to Tampa from Connecticut we started apartment shopping. The first thing we would look at was the pool. If it had a nice pool then we would go inside and see if it had any apartments available. Well we settled for the Manhattan Palms. We moved in the first week of April and its June and the pool has not been fixed. Every time we ask when its going to get fixed, their anwer is by the end of the month.

Its been almost two months and no pool. We have to go to other complexes or community pools to go swimming. Not to mention that they also advertise and tennis court and it has not net. Now what is a tennis court with no net? I have spoken with a couple of tenents that have lived here for more than two years and their answer is that the pool and the tennis court have not been open for at least a year. Now i have a year lease and cant move out. Is there a way to break a lease. Any suggestions please (post a rebuttal)

I recently went through much of the same thing with an apartment complex. After 2 years of dealing with various issues with the complex I lived in, they put a final stab in my back after promising me a washer and dryer when I renewed my lease for the third time. I waited over 3 months and NEVER received the washer and dryer. Unbeknownst to me, they had also not included this in my lease, rather they made me sign a separate sheet of paper for the washer and dryer, which is now conveniently not in my file. I moved out in October of last year after calling and writing letters to the management. They kept my deposit and are trying to get an additional $500 out of me at this point. I found out later on that A) you only have 3 DAYS after signing your lease in which you can break it, and B) that if something is going on that the management refuses to fix, you must send them a FIVE DAY notice (send it to them certified mail to verify you sent it) which gives them 5 days to correct the problem. If they do not, you may be able to move out and still get your deposit back. I recommend that you call an attorney. Most of them will speak with you for free. Try sending the five day letter first, see if that gets you any results. There is a website also for renter's rights. Type "renter's rights" into your search bar and a various array of sites will come up. Unfortunately, I have found that in the state of Florida, the renter has literally FEW (if any) rights when it comes to a situation like this. It is terrible that we have to spend the money we nearly kill ourselves making to live somewhere only to not have a leg to stand on when we get fed up! One other thing you can do, if you decide to move out, before your lease is up, after sending the five day notice to them, is take them to small claims court for your deposit and possibly any rent you paid. Check out the websites I was telling you about though before you do anything. I wish you luck in your endeavor with this complex, you will need it. I hope this has helped at least a little. I know how it is to completely HATE the place you live and feel powerless to fix it!
