On May 31, having agreed to pay $65 per hour on the road times two for deadhead back, I had not left enough cash with my friend when I had to leave for work. He claimed it took him three hours but he was only charging me for two, so he wanted $260. She offered to write a check for the $40 difference between what was here and what he demanded, but he wouldn't accept it, claiming we did not have a contract.
He phoned me to arrange to bring the load back the next night, saying he would charge me only one way for redelivery. When he arrived after 8:30pm, his fee was $462.50 including two $30 fuel surcharges. I argued with him but wanted my stuff. He finally came down to $450, and waited in my house until I returned with the additional cash before he would unload.
With my cash in his pocket, he got into his truck "to turn around." In truth he was parked in the wrong direction, but he had been there the day before and should have known how to park to unload; he could have turned around while I was getting the cash. Because it seemed fishy to me, I asked my housemate to get into the cab so he couldn't drive off with my money and my stuff.
He jumped out of the cab insisting I pay him the full amount or he wouldn't deliver. When I argued with him, he started to give me back the money, but grabbed it back, uttering a profanity, and storming off to drive away. He dared me to phone the police, but the police couldn't do anything because we had a contract.
From May 31 until Wednesday, June 18, he was driving around with my stuff in his truck, refusing to deliver. Wednesday around noon, he dumped everything at a competitor trucking company for my son-in-law to pick up. Sofa legs were broken or missing; parts are missing from the washer and dryer; the washer needs repair before it will work properly; AND HE STILL HAS MY MONEY.
His front truck plate is 9B04816; there are no plates on the trailer. He parks it on Linear Ln off Dimension between Bake and Lake Forest in Lake Forest, CA. His cell phone number is 949-632-9042.
