Debt appeared on my credit report, called company indicated debt not mine.

situation came up i needed item off my credit report, called company asked if I could get a refund if I paid the debt and could prove at a later date that the debt was not mine, I was told that i could.

I paid the debt. I then came into possession of a document from Verizon stating that the debt was fraudulent. I again contacted the company, informing them of my proof. they indicated to me to send in a copy of my proof, which I did.

long story short, they refused to refund the money. A collection company not paying what they owe. There is nothing in writing anywhere that I can find that states that I'm not entitled to a refund now that I can prove that the deby is not mine.

Collection companies retrieve money that people legally owe to others, they are not suppose to keep money that can be proven was not legally owed. I guess they really don't like refunding money do they.

This is a third party collector for a debt that you can prove is not your debt. You can show damages because you paid them prior to having the documentation showing the debt was not your debt. Make sure your documentation is solid and sue them for the refund AND for damages. Look up FDCPA and check your state's statutes to see if your state has consumer laws to back up your claim before you file in small claims court. Some states are very pro consumer, like Wisconsin.

If you are not comfortable bringing them to court, find an attorney to represent you in a suit. The attorney fees may very well be paid by the collections agency if you win. Naturally, you need to decide if it is worth persuing or not. If it is not, at least you learned never to pay a collections agency for a debt you do not owe. Also, check your credit report to make sure they did not put the delinquent debt on your report. Even a paid collection brings your score down.
