Dear Massimo (Maxx),

I am writing this letter per my legal counsel in response to our last phone call conversation. I do so regretfully.

I will not revisit the 7 emails previously sent although they are available and will serve as record along with the police report written and filed by Fleming County Sheriff's Department on July 4th, 2010.

My family has incurred damages that we are still documenting from a negligent move. While I understand you did not pack the truck and cause the damage, nor did Bob Jones, your representative whom I do trust, you did hire and empower these three gentlemen to represent your company and handle our belongings.

I did not hire them or contract with them. I contracted with you. You contracted with them as subcontractors to perform your duty under our contract. In addition to you misrepresenting your abilities and the services I was to receive, none of the movers had a valid drivers license as discovered and documented by the officer. This serves as more proof that you did not screen your personnel, nor put any quality controls in place to ensure the job was done correctly. As you well know, the actions of your agents are imputed on you as their principal, and you are responsible for the damage they/you have caused.

In addition to the damages that will exceed $4500.00, all services were not performed per the contract; this amounts to either an intentional and willful misrepresentation on your part, or non- fulfillment of your contractual obligation to me. The items you attempted to charge me for, but never performed, include but are not limited to:

* Professional Padding & Wrapping of Furniture 
* Disassembly of Furniture 
* Re-assembly of Furniture 
* Unpack after Unloading
* White Glove Treatment

It is for these reasons I intend to file a Better Business Bureau complaint in North Carolina, Kentucky and Florida. Furthermore my legal counsel advised me to write this letter asking you to produce a letter that all payments have been satisfied and that no balance of any kind is due. This letter is required to by end of business day on Friday July 16th, 2010 via reply email to [email protected]. If I receive this letter at that time, I will consider the matter resolved, I will forgive the damage you have caused, and we can both walk away. However, if I do not receive this letter from you at that time, I will assume that you have no interest in correcting your breaches and fixing the damages you have caused my family, and I will have no choice but to pursue legal action against you and your company for your misdeeds.

Please comply with this request to avoid but not limited to, stated further actions.

This company charged our credit card with fraudulent overcharge for unpacking that never occurred. There now is pending a criminal report on stolen property with the Fleming County Sheriff's Office
