I feel that I have been taken advantage of & victimized & I want all of South Florida to know about my experience so they may avoid being taken advantage of too!

Here's my story:

My husband, myself & 2 children LOST everything, including our entire home in Hurricane Wilma. In the process of rebuilding our lives, we purchased 3 new queen size beds, box springs & bed frames from a local retailer Mattresses & More who we saw in the flyer. This place is similar to a Mattress ***(((ROR REDACTED FOR SECURITRY PURPOSES))) store & sells new beds, however, their name is not actually on the bed tags, it's another company called Dixie Bedding Company 4800 NW 37th Ave. Miami, FL 33142, which is also King Koil.

My 87 year old grandfather & I went to MATRESSES & MORE at 7906 Pines Blvd. Pembroke Pines, FL 33024 & met with a salesman named Jr. We told him that we had around a thousand dollars & that we simply wanted 3 mattresses, comfortable to sleep on. We explained what we went through with losing everything in the Hurricane & how we only had so much money from the insurance to rebuild our lives.

The sales man, Jr. who later told me that he is the owner's son, spoke to us & really made us feel like he was giving us a wonderful deal & was going to help us. The owner of the company works at another Mattresses & More Store at Sun Plaza 982 S. State Road 7 Margate, FL 33068 (954) 975-7446. We shook his hand & paid him $1,000.00 in CASH which included set up & delivery (See Invoice).

He told us that he was going to upgrade our mattresses for us & Jr. assured us that they were high quality that would last at least 7-10 years. He said the beds were made by King Koil & that they have been making mattresses for almost a hundred years, longer than any of the other bed manufactures & that they were the best.

We trusted him, which was a mistake.

1 day later, the beds arrived. I met the delivery drivers outside & was shocked to hear so much cursing, right in front of me & my children!! I won't repeat what they were saying, unless you ask. They (2 big guys) ACTUALLY asked me, a woman, to help them carry the heavy mattresses & box springs from the truck into my home, which I did.

Looking back, I wonder why 2 big men needed my help. I offered them ice water, which they drank & to my surprise, they NEVER said thank you for anything. They had NO customer service skills at all. They set up the beds & left. They also left a bunch of garbage outside my door, which I had to throw away!

That night, all 4 of us went to sleep & immediately noticed that all 3 mattresses sag in the middle! We all slept slanted instead of straight. At first my husband & I thought it was because we were overweight but when our little children also had the same complaint, we knew there was actually something wrong with the beds.

I called the mattress store the very next day & no one ever answered the business phone, which I thought was odd???

I left 3 messages & said that we ALL woke up with sincere pain in our backs. He called me back the next day & said he's never heard of this ever happening with these mattresses before, so I immediately invited him to my home, so that he could see first hand how very bad the mattresses sag in the middle when you lay down on them. I told him that he is more than welcome to come & lay on the bed himself to see it so he can believe it. I told him we have nothing else to sleep on & begged him to please help us because our backs are hurting.

I don't think it's fair that we paid, even on a deal, $1,000.00 for defective beds & I asked him to please take these mattresses back & give us good ones. He told me to wait a few days until he could close the shop & come over to my home to see the mattresses, so I agreed to work with him on this & wait for him to come. He never came.

DAYS later I called him back & nicely reminded him that I had been patiently waiting for his call to come. He sarcastically said, Look lady, I'm not coming out to your house to because if the mattresses are defective, there's nothing at all I can do with them. I can't take them back because if they are bad I can't sell them & get my money back that I paid for them & I'm not going to eat the cost, I mean really, what do you expect me to do with them?

Look, the only thing I can do for you , the only option you have, is to wait until I send you the manufacturer warranty so you can fill out the warranty request & see if they will replace them for you, but I can't guarantee that it will be covered. Just know that if they do decide to replace the mattresses, you may have to pay us AGAIN to deliver the new mattresses for you. He got sarcastic with me & absolutely refused to take back the bad mattresses & give us good ones.

I JUST received the 4 page warranty paperwork, ALMOST 2 MONTHS AFTER! I filled it out & have faxed it to them however, my back hurts, my husband's back hurts, my 11 & 12 years old children's backs hurt & I feel taken advantage of, I feel disgusted with how they sold us NEW mattresses that were defective & refused to do anything about it & would LOVE the opportunity to reveal how this injustice has affected my family, because it may be affecting other families out there!

This is NOT fair, it's not right & NO company should do business this way!

* All I want is 3 new BEDS that do not sink or sag when laid on. It's that simple! I ONLY want what I was promised & what I paid for, that's all. I really don't think that's too much to ask! I don't want to pay another delivery fee. I want 3 new, GOOD mattresses & box springs delivered to my home by professional delivery personnel, who will put the beds down without asking me to help them carry them.

We are SICK & TIRED of waking up every morning with back pain! My 87 year old grandfather, my husband & myself & even our 2 children are all available to speak with you to tell our side of the story to let the entire population of S Florida know about our personal experience with Mattresses & More.

UPDATE: I received a call back from a woman named LEE (Who refused to give me her last name) at King Koil at (305) 643-1500. She said that she received my letter (above) & that I would need to send them a check for $50 so they could have someone from their company come out & look at the beds. I also have to pay ninety something dollars per bed to have new ones delivered to my home, ONLY if the mattresses are found to be without any stains, rips or tears. I assured her that there are no rips, tears or stains, as I have good mattress pads on the mattresses.

WHAT?? Is this a JOKE? Is there a hidden camera somewhere? She said that as a courtesy, most mattress retailers do take bad mattresses back, however, they are not required to do so. Mattresses & More is NOT one of those companies who provide this courtesy to their customers.

She said that without someone laying on the beds, there would have to be a 1& inch indentation in order for the warranty to be valid. She also said that when I purchased the mattresses, I should have been given a copy of the warranty. I told her I was not & she said that it is attached to each mattress.

She also told me that if the bed frames do not have a 3rd leg of center support that the warranty is VOID. I told her that none of the frames that were sold to us have a 3rd leg in the center & asked her how I was supposed to know this. She said it was up to me to ask. WHAT??? How is anyone supposed to know to ask this? If the retailer doesn't tell me, then how am I supposed to know? I am not in the bed business! I don't know these things & I am upset even more now because the retailer NEVER mentioned ANYTHING to me. He assured me that if they weren't good, It would be completely taken care of! What does that mean b/c NOTHING has been taken care of? Had I have known, I would have insisted in getting the frame with the 3rd leg.

She said that it's NOT the retailer's responsibility to do anything about it. My question is, Why not? If I had a store that sold a BAD product, I would take it back & replace it with a good product.

If you purchased a new car & drove it home & it broke the next day wouldn't you bring it back & ask to be given a new car that wasn't broken or ask for your money back? Isn't there a lemon law that protect consumers? When you buy anything from a store & it breaks you take it back with your receipt & exchange it or get your money back.

After speaking with King Koil, I now know that if I am going to get any resolution to this matter, I will need your help now, more than ever.
