1-4-05:

Received two vehicles from M&E with excess grease on the interior. Driver instructed me to file a claim with Don Baxter at his office in California. Also, one of the vehicles, a LandRover, had 16 Un- Authorized miles - the difference of the mileage at P/U and at D/Off.

1-18-05

Filed a written claim for "damages" - excessive grease on the interior of both vehicles, the 16 miles, and the additional miles driven to have the cars detailed. I provided all the documentation that was requested.

1-27-05:

Rec'd call from Don Baxter in claims, reviewing claim that he received yesterday, however the conversation was not finished, he would get back to me within the hour and the hour came and went.

1-31-05

Missed Don both times when I called.

2-1-05:

Called Don again - our conversation started of somewhat decent and went down hill very rapidly. Don quickly started to quote the "terms and conditions" on the back of the paperwork (that you don't get UNTIL they are there at pick up and in the dark, mind you. Basically throwing all the responsibility for the negligence of the drivers back on to us, that we need to file a claim with our insurance, that is nubmer 16, how I barely got the paperwork in on time - thats number 19. And that nothing I do will EVER hold up in court- nobody ever said anything about court at that time. Once he stated "there is an 80% chance that the owner will not take care of this" - we got into a yelling match. Funny how Don was so quick to know how much liability to get out of on the back of his paperwork HOWEVER, the very first line under "TERMS AND CONDITIONS STATE: "THE TRANSPORTER WILL NOT BE RESPONSIBLE FOR ANY DAMAGES NOT RESULTING FROM TRANSPORTER NEGLIGENCE.

I consider excessive grease all over steering wheel, floor mats, interior roof, driver door and seats - that it actually required professional detailing AS NEGLIGENT.......

Not to mention that the car was driven 16 miles and was not authorized. That is THEFT.

Needless to say, he hung up on me after we got into a yelling match - him telling me to let him finish but when I started off the next round of conversation by stating "I have a question for you" and he then finished my converstion for me by being accusatory - it got really ugly.

Our Claim is for $257.00 for 2 interior car details and mileage.
