I, unfortunetely, have already been dealing with "Mike" over the lack of a certificate of title for a vehicle I purchased from him back in October of 2008! Still don't have the title even though I paid for the car and have the car in my possession. We suspect that it has been in an accident also, but that wasn't disclosed when we purchased the vehicle. We'll have to do some investigating with a body shop to find out for sure. I wish I had gone online and checked out him and his company first, before forking over almost $11,000. He also says he's not in the car business anymore. If true, that would be good, but I'm then concerned about any business dealings he has with other unsuspecting and decent human beings in the future. My advice when purchasing anything from an individual is to check them out thoroughly before you lay any money down. If they have negative feedback, you might want to think twice before dealing with them. Liz in Richmond

David, I have had something very similar happen with Michael and his company. I have filed a complaint with multiple organizations (see my report below). You need to file a similar complaint with the following: DMV Investigations Dept: www.dmv.ca.gov/forms/inv/inv172a.pdf Form INV 172A send it to the SF address (415-330-6469) and you can reference my complaint #082300498 Bureau of Automotive Repair: Fax Walt at 650-827-2038 Indep Automobile Dealers Assoc. of CA (IADAC) Kirk Shorter [email protected] AutoTec: www.autotec.com - his member # is 100598906 Better Business Bureau: http://www.goldengatebbb.org Consumer Affairs: ConsumerAffairs.com FTC Consumer Sentinel: 1-877-FTC-HELP ABC-7 News and 7 On Your Side: http://abclocal.go.com/kgo/feature?section=news/7_on_your_side&id=5814629 Here is the exact complaint that I filed with the DMV that is ongoing: The ad stated that the car "runs and drives like new" and the dealer reported that he had the car safety inspected. This is a vast misrepresentation. The car is unsafe to drive. The passenger's side front seatbelt is nonfunctional, the brake discs are below specs, the transmission housing is cracked and leaking, there is a coolant leak going into the hybrid system, and the right turn signal in the dashboard does not work. The brake and lamp inspection paperwork that was later sent in order to register the car is dated after the delivery of the vehicle and therefore, is falsified. This has been reported to the Bureau of Automotive Repair. The dealer did not represent the car As/Is and will not repair the problems. The dealer did offer to sell us an extended warranty after the problems were presented to him. I spoke with our mechanic regarding this and he said the dealer should know that this would be considered fraud because it was a known pre-existing condition. The dealer said the car was a recovered stolen vehicle and therefore, had a "salvage title/theft" and was not involved in any serious accident. This is another misrepresentation. The car has weld marks on the frame, and coupled with all of the engine/transmission problems, suggests that the car was totalled. A CARFAX Report verifies this. I requested a refund within 72 hours of the transaction, and the dealer stated that he did not have enough cash on him, so I could wait or he would be willing to sell it for me on consignment for a fee. To me, this is unacceptable and I have continually left voice messages asking for a refund. The dealer has been very uncooperative and has since stopped returning my phone calls. Sterling

Through all the hard work that we go through everyday it is good to get a good laugh at a creative story like yours. Its been a long time since you have last threatened us verbally over the phone so its nice to see that your story is at least readable by all ages online ;] Whatever damage you have done to your car in the multiple months you have had it for is not our responsibility, I told you if you had any issues with your car down the line I would be happy to use my resources and contacts to help you with your car...that definitely doesnt mean that I will pay for them out of pocket like you have suggested I should and it definitely doesnt mean that I will buy the car back from you at 100% plus reimburse you for reg and taxes.....thats like going to the store and buying milk, drinking half of it, putting the cap on, kicking it a few times and then going back to the store threatening the owner of the store and then ultimately posting funny stories on websites on why the owner wouldnt pay you back for it. And as far as you creating fake stickers to try and set us up with DMV....I am still debating having my attorney go after your house for that one, takes a lot of guts for someone like you to do something like that. You are a creative guy and I am sure you will do well in business one day when you put your energy into something productive...wishing you the best.
