I received a collection notice from MCM for the amount of $224.19 listing the creditor as National City Bank. I have never done business with a National City Bank that I can remember. MCM also has the incorrect middle initial of my name on the notice.

I also recieved another collection notice mailed to my home address that had another persons name on it, (someone that is unknown to me,) with the exact amount of $224.19 owing, exact creditor, exact account number, and exact letter number! The two collection notices were identical except for the names!

I got a phone call from someone from MCM yesterday, they could barely speak english, and I told him he had the wrong name so he hung up on me.

I will be sending this info to the FTC, and I am good at writing letters. Hopefully this will nip any future mailings or phone calls in the bud.

Any further suggestions on how to deal with this bogus collection notice would be appreciated!

Thanks Steve and Heather for your help. Heather, I'm new at this so need to know how to find buddhibbs website that you mentioned! I've kept both letters and envelopes. I've also written a letter to MCM and will be mailing it out tomorrow Certifed mail.

Mike, SAVE THOSE LETTERS (and envelopes if you've got them). Those would most probably be great evidence in a class-action lawsuit against MCM. It looks like they're collecting the same debt from more than one person. Email buddhibbs at his website and let him know what you've got in hand. He'll get you in contact with an attorney that will most probably start drooling.

Mike, These are JUNK DEBT BUYERS attempting to validate and collect on a junk debt they bought for pennies or less on the dollar. They are fishing at this point, by sending letters and/or calling everyone with the same or similar name to that of the original debtor. NEVER speak to any collector on the phone, as it will get you nowhere. And, the letter you send to the FTC will not bring anything but an automated generic response. The FTC does not do individual enforcement. And, you can do that complaint online. You must respond in writing and by certified mail, return reciept requested. Be sure to put the certified# on the letter itself, and keep a copy for your records. This is very important as it proves exactly what you sent. By the means above, send a DEBT VALIDATION request to the lowlife. Clearly dispute the debt, and then demand to see the original contract that created the alleged debt, as well as a full account history and itenization of charges. DO NOT sign the letter, just print. Also if they claim to own the debt, demand to see the purchase contract, full chain of title and proof of payment as well as proof that they are licensed to do debt collections in your state. Until they provide you with adequate validation, collection efforts must cease. You can also sue them for your time and expenses due to them going after the wrong person. Don't get mad, get paid.
