 I purchased advertising through N2 publishing for one of their magazines in the Indianapolis area. As a new business starting up, I was in a position where the business was myself. I had plans and goals to expand beyond that point, but before I did I became ill.

Consequently, this illness required me to close the business. One of the steps was to contact N2 publishing about the advertisement running in their magazine. I expressed interest in cancelling the contract. After all at this point, the business though not officially closed was no longer operational and any customer responding to the ad would be disappointed. When I contacted N2 Publishing my website had been taken down, email accounts etc.

 In effect their was an ad running in their magazine for a business no longer operational. The response from N2 publishing seemed to be the standard response that I see here on this site. You signed a contract, your responsible for it.

Certainly, I understand this. However, there seemed to be no concern from their end how they would fulfill their end of the agreement/contract  - provide advertising for the period of the contract. In effect the only way for them to do this would be to have an ad in their magazine for a business, no longer operational.

It did not occur to the management or the sales representatives that both parties signed a contract. I should think that if I am required to fulfill the consideration they(N2 publishing) should be responsible for performance. Which would be continuing an ad for a business no longer operational with there full knowledge of this.

And yet this did not seem to be of any concern to N2 publishing.

To put it another way, N2 publishing didn't seem concerned at all for their customers, the readers of the magazine. Indeed, who would want to do business with such a company.

In addition, they seem to feel that performance is a one way street, businesses that advertise should fulfill their portion of the contract - the consideration. While they seem to have the opinion that the performance end is much more flexible.

By all means, at this point I am not sure how this will turn out legally. Whether I will be required to pay for an ad, for a business that isn't operational.

I expect to hear the standard - you are responsible for the ad, in their response. How it plays out for me, I am unsure. However, my advice to anyone reading this complaint - stay away from N2 publishing. There are certainly enough complaints about there practices.
