What would you do if you discovered that a year after purchasing your vehicle you learned it had clearly not been inspected by the dealership prior to sale and that it had a damaged engine as a result of poorly repaired head gasket previously worked on before you bought it?  

Wouldn't you'd expect the dealership where this car was purchased and where failure to inspect to inspect the vehicle (it also had a leaky radiator a day after I bought it) was obvious to accept some responsibility for the damaged engine costing $4500 to replace (used)?

It didn't happen. Instead, after carefully explaining my situation, the "Head of Finance" Howard Bass brazenly pointed responsibility elsewhere (with a silly rationale) and then basically threw me out of his office.  

I don't know Napleton's complicity if any in this if any but right now I've been out a vehicle for 30 days with a mail order business which has been put on hold.

The extended warranty would have covered the repair of the head gasket but because it was repaired once already and the repair ultimately permanently damaged the engine, they rejected the claim,

Goodwill means nothing to them.

Nor does a proper inspection of their used vehicles prior to putting them up for sale.

All this compounded by fax (enclosed) in which a repair is noted on 4-17-17 for a head gasket and radiator. I owned the car by this time and knew nothing of this shop before I pulled the car fax yesterday (6/17/18)

Clearly, this entry was made by the Apex Automotive only after they saw that the car had sold because the repair was made previous to the 2nd owner selling the vehicle.

In other words, both the date and the mileage are fraudulent and my guess?  The listing was posted only after Apex noted that the car had been resold.

I speak to the Apex people tomorrow.

I mistakenly thought that a clean carfax would get me through and (as I did) if every repair was made by my own mechanic regardless of freebies offered by the dealership would get me through.  I was wrong.  Today I saw their finance manager who tossed me BS accepting no responsibility and basically throwing me out of his office.  I told him that his excuse wouldn't wash with either the State Attorney General or with my attorney.  They know I'm coming.

 Next time, pick a better dealership...not a place which has a WELL KNOWN reputation MASSIVE problems regarding integrity and honesty. Check your paperwork. How much did they DEFRAUD you with a bogus, add-on, PHONEY fee. $600-$1000??? Every place they operate, their reputation is GARBAGE. Their stench, smell, slime is that of an uncleaned portable toilet. They and their reputation are WELL KNOWN in consumer protection circles, the courts and among their peers.

The vehicle received regular maintenance since I owned it.  No one is going to take apart an engine unless something is wrong. Nothing was wrong until May 2018. 

Both dealers and consumers rely on CarFax. Information submitted only after a sale has taken place raises red flags especially to consumer lawyers and agencies of government that guard a consumer's interest. 

The warranty company has agreed to reimburse only for the cost of the head gasket work which takes a few thousand off the replacement of the engine. Of course, putting on a new head gasket is fruitless for an engine with a damaged block so it'll go towards the "new" engine.

Which I won't be paying for.

- No..so why would you? When you bought the car you either bought it "As-Is" meaning that anything and everything that goes wrong is your responsibility, or you bought it with an extended warranty. If you bought an extended warranty, then unless that item is covered under that warranty you are once again responsible.  If the warranty company denys the claim, then that is an issue with the warranty company. Where depending on the exact circumstances you may have a valid reason for a complaint.

As to your specific "failure".  First off I wouldn't hold much stock into the "report" you pulled, as many times these "reports" may not contain the most accuate information.  It could be right, but it could just as easily be wrong in some key items making you think something that isn't the case.

Now, if you already owned the car by 4/17, it has been more than a year. But in this time you should have had your car in at least a few times(3-4) for general maintenence. Did none of these pick up on the "defect"? So even if the dealer did inspect it, trying to make a claim that they would know the part will fail in just over a year is going to be very hard to prove.  Especially if no one else past that point also did not notice it.

If your answer is that you haven't taken it in for maintenence, you have bigger issues with any claim. As one thing the warranty company will require is proof from you that you are following the maintenence schedule.  They will require ALL your service records and if they don't meet the recommended intervals for your car they will have legitimimate grounds(per the written warranty) to deny your claim.

I don't know Napleton's complicity if any in this if any but right now I've been out a vehicle for 30 days with a mail order business which has been put on hold.

- Unless the warranty covers some sort of rental car, or loss of use then that is on you. But then again just curious why would you need a car for a "mail order business". As if you are doing things through Mail Order you can not only have things sent to you by mail but ship them out and have them picked up by various carriers.
