 They said they served me due process but on court documents the acount of the person they served, my wife, a petite Japanese woman, was "a middle-aged Middle Eastern man 40-50years old" . It is clear that they never had a right to hold the hearing because I was not made aware of the lawsuit. I have since hired a lawyer and had the default judgement vacated. The lawyer telss the trial will be next year but they will settle by then. 

What gets me here is that this group of unswcrupulous assholes are manipulating and cheapening our sacred legal process, the finest in the world, to accommodate their own selfish greed. This site and others are full of complaints about them.

I accept that I fell short of my obligations. Sure, the bank is entitled to file a ripoff report on me ... in fact, they did, with experian, TRW and equifax. And your point is?

Mason, you're assuming this guy is a deadbeat. He may well be, but he also might have an ongoing legitimate disagreement with them over a billing mistake, overcharging, or fees above what his loan agreement specified, etc. The bank or loan servicer maybe was playing games, always arranging for payments to be processed "late" no matter when you send them. Applying payments toward interest only then claiming you're behind on prinicpal payments.

They've done all kinds of things and not just notorious cutthroats like Ocwen, the big banks too. Whatever the issue might be, doesn't excuse these bill collectors from breaking the law and lying to the courts about process service.

 Of course, you not paying your bills in the FIRST place was not unscrupulous and has nothing to do with this, right?
