I issued this complaint about my neighbors recent construction:

 

I am in Lewisville, Tx.  I asked the city to review my neighbors recent construction next-door because they raised their yard level by 3 feet and installed a pool next to  the fence with a 2 foot wooden-retaining-wall (the pool and its construction has caused flooding on my property when it rains.  In my complaint I said that too much work was being performed without follow-up inspections.  I thought they would make the homeowner fix the issue but Code Enforcement replied to my complaint saying my only course of action was to sue the neighbor.  The next day Code Enforcement came to my door to let me know that they were working with the neighbor to make "SURE" all their papers were up to date with the proper inspections (no corrections to construction were made).  Code Enforcement came by the next day to cite me for drainage issues from my pool and wants me to alter my drainage.  My pool was constructed in 2004 under permit and past inspection in 2004.  Now the city wants me to reroute the pool drainage to drain inside my fence which will also flood the other side of my property.  My yard is flat and does not allow for drainage inside the fence.  I count at least 30 neighbors using the same pool drainage as my house.  My pool was designed to drain onto a paved asphalt alley in the rear of the house.  Other houses on my block use the same pool drainage method.  Perhaps Code Enforcement took my complaint as an attack on them when my intention was to correct the construction next-door. Can the city treat me differently than my neighbors in this seemingly retaliatory manner.  I called Clovis Joiner (Neighborhood Services who said he will have an Engineer look at it.  He sent the same guy (who is unexperienced and admittedly is new to the position and is not an Engineer to tell me how he wants the job done.  If I change the plumbing the way he wants it, I will flooding my yard.  He has given me until the end of April to have work completed.  

Can the city treat me differently than my neighbors in this seemingly retaliatory issue?  

What happens if I do not compy?
