Complaint Review: Ocwen Federal Bank - West Palm Beach Florida

I just returned from Chicago, Illinois, where with my lawyers I attended the first court hearing in Federal District Court relating to Ocwen and Moss Codilis since mid-April when the MDL Panel combined all eight class actions against Ocwen and transferred them to Chicago. The hearing occured on June 24th.

I am absolutely committed to fighting for justice for each and every victim of Ocwen (and anyone who doubts the extent and unrelenting nature of that passionate commitment should walk into the Chicago Federal District Court clerk's office and look up the documents on file in the case of MDL No. 1604). In fact, I encourage ANYONE and EVERYONE whose house is under seige by Ocwen to fly to Chicago to access the records or find a way to get someone in Chicago to go and get selective copies (the clerk's office charges by law for copies, mind you, so prepare to spend a small fortune).

I have given my lawyers strict instructions that a quickie settlement is NOT what we are after. We are after justice, and if that puts us at loggerhead swith anyone else, we have already made our views known in court documents. Ocwen has destroyed so many lives and homes (and continues to do so, according to the dozens of new email complaints I got while I was away in Chicago last week).

My heart aches for all who have suffered during the past two years that I have devoted day and night to systemmatically fighting Ocwen and Moss Codilis. For the skeptics out there who do not believe that our methodical attack plan has been working, do a double-take. While I cannot overtly say everything here, read between the lines, and also take my word for it: We have hit harder than a heavyweight champion hits, and Ocwen is feeling and reeling from the punches. Don't believe me? Call the Clerk's or Court Reporter's Office if you wish (as is your unfettered legal right) and order the transcript of the proceedings on 6/24/04 at 10 a.m. in front of U.S. District Judge Charles Norgle, Sr.

That transcript alone (which costs less than probably $400) MAY PERHAPS POSSIBLY MAYBE help save your home in a state foreclosure proceeding, if you are able to get the foreclosure judge's attention on it.

However, the battle is far from won. It is up to EACH AND EVERY VICTIM to make sure that his or her voice is heard. Vote with your pens and paper and stamps (preferrably certified mail). Make sure that those who claim to represent your interests (my lawyers included) HEAR from you directly or through named representatives like me. My address is probably the only one publicly posted elswehere on this site, and my email is widely available (but please, notarized, PAPER MAIL is preferred over EMAIL, as sometimes that may be considered inadmissible hearsay by a court).

As for me, come the day when I am gagged (as some would very much like to see happen to me now so the wheeling and dealing can be speeded up [hey, I have a First Amendment right to my opinion and free speech] or otherwise silenced, be sure that there are folk who "TELEPATHICALLY" read my mind [now you all will raise eyebrows at that, but read it in the context of this entire comment]). Those "telepathists" will continue to voice their own opinions and cannot be effectively gagged and will continue to encourage, suggest, and guide victims regarding how to stand up for your rights.

Hint: "Ahh . . . Kansas"; "My Mummy" in Florida; "Buffalo Soldiers;" "Robin Hood;" "Florida Marlins;" "Princess Diana;" etc. All these historical characters are very much alive and well and will continue to speak out because their jaws cannot be wired shut by any orthodontist, if you get my drift.

Meanwhile, WE SHALL OVERCOME. I said it two years ago when I began this war against pirates and pilferers. I said it one year ago when we turned up the heat even as the one-eyed Willies from Florida speeded up their stealing of homes of widows, single parents, young couples, elderly persons, middle-aged families with kids who had to move and lose all their school mates, etc., etc. We took on Ocwen when Ocwen laughed and in press releases called our class action "baseless, bogus and misguided." Ocwen is eating its words now, but the damage has not stopped. Ocwen is looking to slither out of the noose with the same arrogance with which a John flashes a few dollars at some streetwalker. But we are no streetwalkers. We are abused homeowners who deserve our dignity restored, our credit repaired and our just compensation, and we will NOT settle for pennies. I know I will absolutely NOT settle for pennies. I would rather fight until a jury declares my rights and Ocwen's wrongs, if need be.

So Ocwen, get out your calculator and start doing the Math. I have fought you for two years, and I am far from weary. The Bible says in Isiaiah that "those who trust in the Lord shall renew their strength. They shall mount with wings like eagles. They shall run and not grow weary." Listen up, whole wide world: Ocwen's victims are stirred up and anxious for justice. We are ready to press our lawsuit for the next two years for ture justice than to cut and run in the next few months. Ocwen, your SEC filings reveal how much these class action lawsuits have cost you during the past two years, and you have started selling buildings, moving into smaller offices, and reached a lip-service Customer Service Supervision Agreement with the Office of Thrift Supervison to get some heat off your back.

You want peace? Stop the computer hackings and virus attacks (for which you risk a massive CAN-SPAM lawsuit). Stop the harrassment of borrowers whose timely checks you are deliberately posting late. Stop the false foreclosures and crooked credit reporting. You saw my absolute determination in Chicago. You realized that I will not be easily silenced and that my lawyers work for ME, not the other way around, because as my pleadings make clear, I have funded this case for two years from my own pockets and have saved up to continue to fight on for years to come! And if we get to the point when we run out of funds, I am sure fellow victims will donate (many have offerd in the past to start a legal fund to help out, but I have declined donations, as old timers here can confirm).

OCWEN and MOSS CODILIS: BE THANKFUL THAT THE THOUSANDS OF VICTIMS HAVE NOT EXERCISED THEIR IMAGINATIONS AND COPIED OUR CLASS ACTION COMPLAINT WIDELY AVAILABLE ONLINE AT THE CBS WEBSITE, CUSTOMIZED SUCH A COMPLAINT TO REFLECT THEIR PERSONAL SITUATION, AND EACH SUED YOU IN A FEDERAL COURT TO GET AN INJUNCTION WHICH WOULD I=NSTANTLY SAVE THEIR HOUSES, DEPRIVE YOU OF THE PROCEEDS OF A QUICK FORECLOSURE, COST YOU MILLIONS MORE IN FRESH LEGAL FEES AND MAKING IT HARDER FOR YOU TO RESOLVE THESE CASES. BE THANKFUL THAT I HAVE NOT RELEASED THE TENS OF THOUSANDS OF PAGES OF FRAUD THAT YOU KNOW ARE ARCHIVED IN FIVE PLACES IN NEW ENGLAND, EVIDENCE WHICH WOULD MOST LIKELY RESULT IN CRIMINAL CHARGES AGAINST YOU IF TURNED OVER TO THE LIKES OF N.Y ATTORNEY GENERAL ELLIOT SPITZER. Wanna Bet Me? No, I didn't think so, since your experience has taught you that this lawyer (me) is not a bluffing man. As a lawyer experienced in class action lawsuits, I have taught you that no amount of big law firms thrown at a determined plaintiff can make the case disappear.

To all Ocwen fellow-victims (yes, victims---no need for sanitary, neutral words when the proof of piracy is right in our hands) who read this: the more "rebuttals" to this specific post there are by you all, the more the post will remain near the top of the 700 Ocwen posts, to enable others to read and stay abreast of what is happening.
