my house note was at 6% in June of 2005 ever 3 or 6 month they raise it i was suppose to be on a fixed rate because i am on a fixed income they were taken automatic withdrawel out of my account. i filed bankruptcy only again credit card and medical but not the housenote and my joint account on a car they car the people who had my car loan and asked if i had filed against them they refuse to except my money they said they could not talk to me and they stop taking my payment for the house so i send a cashier check for the two month plus the up coming month they kept one payment for a lawyer charge me bankruptch fee and filed against my credit that i filed bank. against them and another 850 for bankf and

Joyce, if your rate was fixed then it should be on your closing papers you signed with the attorney. Also, I'm sure the attorney that is handling your bankrupcy has documents of where you didn't add Ocwen under your bankrupcy. I would find that paperwork and make sure. If you are on a fixed rate for your home loan, they can not change it. What you need to do, is find another attorney to speak to about Ocwen. I went to one for advise and he did not charge me. And if for some reason, I end up having to take Ocwen to court I will not have to pay anything out of pocket. Keep us posted. Good luck!

Ocwen refused to take my payment for two months when i sented three month plus the upcoming month. the sheriff was coming to take my house so they said i stop taking my meds because i could afford them and pay the house and the took it and said they had to pay there lawyer. so that put me behindand i had just gotten out of the hospital. i could not take it but i did't want to be a loser so i use the money i had saved for my daughter college and she missed out another year taken care of me. then they went from 650.00 an month now it is 950 every 6 month and then they said i did not have a fixed rate when i know i did. they wanted my house. now i can't fix it up. they told people i filed bankru.against them i said no i did not and they said prove it and they kept taken the money for there lawyer. I asked them why do you keep raising my payment knowing i am disable and on a fixed in income..they said why don't you get something you can afford.or get a job ...and i hung up on him

Joyce, I agree, the first thing you need to do is contact your attorney. If Ocwen has found out that you are having financial problems, trust me, they are going to do everything they can to foreclose on you. And if you don't stop them in there tracks now, they will. Keep sending your payments, and let them send them back. Keep everything. And I mean EVERYTHING! Good Luck. As you can tell from this site Ocwen has an active history of trying to screw people over. Don't let them do it to you. I didn't. Good luck and keep us updated.

You filed bankruptcy, including several creditors, with the mortgage being excluded. Which chapter did you file, chap 7 or 13? Were you supposed to pay through the trustee? Did the trustee drop the ball? In some cases, you are NOT allowed to make ANY payments that haven't gone through the court (and a company CANNOT accept a payment that is made without permission). Other companies will make any excuse to get your home, and use a bankruptcy as an excuse. You really need to contact your attorney to find out what your situation is. In any bankruptcy, you have to notify the court of ALL of your debts, and those debtors, included or excluded are notified of your filing. To the best of my knowledge, the only way to resolve this is through your attorney. Please keep us updated.
