We hired Shawn Peck of Peck Holdings LLC & Nationwide Equities, to help modify our mortgage. In November 07, I paid him $750 which was required up front. He almost immediately said he had reached a agreement with my mortgage company and promised the settlement papers would arrive for us to sign.

I called and emailed him constantly. Each time there was some excuse or he would claim to have spoken to them and it would be a couple of days. He even told me it would be ok not to pay the mortgage and that it would all be added into the new loan. I finally got tired and called my mortgage company. They had never heard of him. While they had some papers they could not proceed without my filing something. Shawn Peck insisted that he had indeed been speaking with them.

By this point I had not paid the mortgage and am in trouble. The next thing I knew Shawn Peck had taken $550 from my bank account. I called him and told him it was fraud. He mentioned the agreement I signed which only states that I owe more money at the end of his service. What it actually says is that I would owe another $500 and then an additional $500,when everything was done The remedy per the contract if I didn't pay, was to put a lien on my property. He claims that he was allowed to draft my account which he was not. I filed all the necessary papers at the bank and filed a police report. Now I find he has taken another $1000!!! My bank says it takes 90 days to give me the money back. This person is a thief!

This is absolutely unbelievable! Yes, papers were faxed to the mortgage company, however that was all that was done. They never spoke to him. Word for word on the contract "I fully acknowledge that I am required to pay the sum of $500.00 at the time of application payable to Peck Holdings LLC and another installment of $500 at commencement of services." Nowhere does this give Shawn Peck permission to take my money. According to the bank these were forged checks! The contract also says "if not paid in a reasonable time Peck Holdings LLC can get liens or judgments. Again, NOWHERE is permission given to STEAL from me! And yes as a Realtor for 23 years I can read contracts, and fully understand that this person illegally accessed my account. Charges are pending in this matter.

Checks were never forged from a customers account.This is erronious, Peck Holdings like many other companies will create a draft for deposit. Drafts do not require a signature for deposit, there was NEVER any checks forged. When a customer authourizes Peck Holdings to draft their account we will. We are very flexable with our terms and often will give the customer "a reasonable amount of time" at our discretion to pay us. The customer alledges that we did nothing to modify the mortgage, that's why there is mention that the mortgage company had our paper work to modify.(How did the paper work get there if we did nothing and talked to no one?) We would NEVER advise a customer to NOT pay their mortgage. If a customer doesn't pay their mortgage it makes our job difficult to execute. The key in negotiation is to pay while in the process of negotiation. There is nothing further to dignify with a response. The customer signed a contract. Now alledges we did something wrong. This customer knows contracts, considering the occupation as a REALTOR for 15 years. I regret that there is any misunderstanding or miscommunication. We stand by our mission statement and are vehement about upholding compassionate ethical behavior in a trying time for the customer. It our objective to help people that can follow direction and meet us half way. A customer with a superflous mortgage payment that doesn't have the means to support it, may need to reevaluate their financial position. Sometimes the only option is the option the customer does want to hear. To rebuff the situation is not an effective way to deal. We had a scenario worked out,The client didn't pay the mortgage and all efforts were aborted. Regardless, our time,consultation,and resources that are expended still must be compensted. I wish the customer all the best.

In response to the rebuttal that was filed. None of that was the case. Mr. Peck assured he was in touch with my mortgage company which was a lie. None of this has anything to do with the face that he STOLE $1550 from my checking account by forging checks. He strung me along then helped himself to my money. I am not a consumer that he could not help. I am a consumer that he pretended to help when in reality he did NOTHING!

I'm stunned by this person's defamatory banter regarding Peck Holdings. In this type of business it is impossible to help everyone. We never make promises we cant keep, and truth is not everyones credit can repaired to a 720 FICO, not every bank is willing to do a short sale on OUR terms, and not every mortgage can be modified. We disclose this to every customer upfront and its in the service agreement contract. "We make no warrants or representations as to the congency on ineffectuality of entering into this contract with Peck Holdings LLC" "I understand my home is in foreclosure or may be in the process of foreclosure" The foreclosure business is a business. We do not claim to be a 501(c). We are a for profit business and pay taxes as such. We sincerely wish that we were able to help everyone(We could then solve the US housing crisis alone) we deal with but that is simply unrealistic. If a customer authourizes to us verbally to draft their account we will. If they have buyers remorse and want their money back, we simply can not refund money if our services and time have been extended. The contract does make mention of placing a lien on the customers property. This is a last resort. Liens often end in Peck Holdings filing to foreclose. The liens if paid off, accrue's interest @ 33% plus counsel fees,filing fees, and admin charges. This is a last resort method. If a customer charges back their fee for service, this method of reasonable recovery will be utilized. There are far more people that appreciate what we have done for them. The reality is you cant please everyone, but we strive to reach out and help as many people as we can. It's unfortunate that when people find themselves in a precarious financial situation they point the finger and blame others for their issues. We are here to help, not hurt people. A customer with an unreasonable request or a lapse in memory is also and area that we can not help.
