My fiancee, Eddie and I ordered 2 pizzas from Pizza Hut in October of 2001. They were delivered nearly 2 hours later.

We called to complain and they told us that the pizzas were free. Eddie ate the thin crust cheese pizza while I ate the pan crust meat lovers. 10-12 hours later, Eddie began to vomit. This continued throughout the night. He was still sick in the morning and called into work. I went to work even though I was exhausted from being up with him all night.

Around 11:00 he called and asked me to take him to the hospital. Upon arrival they began him on 3 different IV's to help rehydrate him and also to inject some antibiotics. he was diagnosed with acute food poisoning. We were there for nearly 4 hours. During the course of that time I passed out from fatigue. After they completed Eddie's treatment he was prescribed two different medications. We contacted the local store that we had ordered the pizzas from and were told to gather all the bills and bring them to the manager.

My father passed away in November and as soon as I returned from his funeral I gathered the necessary documents and passed them on to her.

I was contacted by a man named Robert who asked that I provide him with the same papers. He then informed me that the company would only cover our out of pocket expenses.

I repeatedly tried to explain that the total amount, nearly $1000.00 came off our yearly maximum and had caused us problems with later doctor visits.

He asked for more documentation which I provided. I had my cell phone shut off for personal reasons but I left messages with Robert advising him of the number we could be reached at.

To date we have heard nothing. I am not asking for any more than what is necessary. I do not expect the company to pay for my time missed or the late fees that accrued because we had to cover the medical expenses. Those amounts far exceed the co-pays.

Eddie is 21 and I am 19, we cannot afford to have our credit ruined just because we ordered a pizza. This company does not care and has yet to make an attempt to help us out.

I will NEVER order from them or their affiliate again. I am in the process of filing a lawsuit now, but it's a shame that we should have to go through all of this just because some delivery guy took his sweet time.
