My daughter signed up to win a "free" health club membership to Premier Fitness while she was at an icecream parlor a couple of years ago. Magically, she was contacted not even 1 week later by someone from the center telling her that she had won a 1 month membership but would need to come in within 1 week and sign for it. She went in and spoke with this guy who asked for her debit card number because they needed something to "verify" that was the actual person who had put her name in the box. She was 18 at the time and very naive. She gave him her number and signed the paper and was given her membership card which was supposed to have been for 1 month and for free! She came home with a copy of the paper that she had signed and I took it upon myself to be skeptical and read the fine print. Turns out that she had actually signed up for a 2 year membership and that they were going to start debiting her checking account the next month unless she came back in within 3 days and signed cancellation papers. I sent her right back in and she signed the papers. One month later her checking account was debited by Premier Fitness. I called them and they stated that they didnt have any proof that she had cancelled and that the man who signed her up didnt even remember talking to her. She only used the "free" membership a couple of times the first week and never stepped foot in the place again.

The is place is a ripoff and now today my daughter received a letter in the mail from an attorney asking her to pay half of the settlement. I emailed them back and told them that she was scammed and never received any of the services for which they were charging her due to the fact that she had signed a cancellation paper.

We are very interested in filing any type of class action suit against this company and their fraudulent acts.

A class action requires a group of victims that have evidence of a loss due to negligence or fraud of another party. Without evidence you will be unable to find an attorney to represent you. Advise your daughter to read before signing and always obtain a copy of any signed contractual agreement.

She should have smelled a rat when they required her debit card as identification.

She came home without a copy and I called the company and was told that they dont give copies out and that I would have to request it from the head office. I called them and was told that they had never received a cancellation and that my daughter owed for the 2 year contract.

Did you send the attorney a copy of the cancellation agreement?
