premier fitness Breach of Contract, and they won't let me out of it!! Oshawa, Ontario
I signed up for prsonal training sessions on July 19th, 2011. I have a hectic schedule and asked if they would be able to accomodate for it. They said yes. I did not receive any sessions for 3 weeks. I went in weekly, and they just toid me that they would call me, and they had the perfect trainer for me. I was assigned 3 or 4 different trainers. All of which cancelled on me at the last minute, or did not show up for scheduled sessions and did not notify me.
After over a month, I still had received no sessions. At this point I'm frustrated. I want to cancel my account. On or about August 23rd, I had called them. I went in once a week prior to this to speak with them. I told them when I called that I wanted to cancel. They said I could not, because I only had ten days in my contract where I could cancel. It had been over a month, and I had paid 321$ with nothing to show for. They refuse to cancel my contract, or respond to my phone calls or emails. I was told by the manager of the gym, Sam, and another man, Ken, that it was possible to cancel, and they made me sign a form. I called head office, and three weeks later, they still had not received any forms from the gym, and they just tell me I'm unable to cancel my account and if I don't pay, it will go to collections.
This is absurd!! Had I known that after a month of payments, that I would not be receiving services, I would have cancelled within the ten days!! I want out of this contract, and I want nothing to do with that company! They are horrible, and obviously lack professionalism and diligance.
