My step mother and I signed for a one year membership with Premier Fitness (Dundas and Dixie location in Mississauga, Ontario) back in October, 2008. We both stopped using the facility in August, 2009 (even in their system clearly shows when we last visited) and I verbally told the receptionist that we would like to cancel our membership. The receptionist simply said 'okay' and that was it. She didn't give me any forms to signs and since then we never went back.

February of this year, my step mother had to go back to her country for a family emergency. She then reviewed her CC statements and realized that Premier Fitness has been charging her every month since November, 2009 til now. I immediately went over to the Premier Fitness to speak to Tracy, Customer Service Manager regards to this matter. To my suprise, both accounts were still activatied. I demaded the money back but she said without the original contract (which we threw out after we cancelled back in 2009) she couldn't do anything about it.

So I requested to get a copy of our contract since Premier Fitness keeps the original section of the contract. However, she said without the manager who we signed up with (which ofcourse no longer works there...) it's difficult to pull it out from their head office.

I went to Ministry of Consumer Services site and under "Your rights when you join fitness club" and the Consumer Protection Act, 2002, it states that all contracts must end in one year and the service must provide a separate written agreement 30 days in advance before your contract ends. I NEVER received any letter from them regarding the renewal.

I am currently writing a complaint letter and hoping they will reimburse me the money back. If they do not reimburse me the money back, I will have to take this little further.

For those who are thinking about joining Premier Fitness (especially Dundas and Dixie lcoation) please please please becareful.

I am sitting on my case at this time, however I will be taking so actions to resolve the issue soon.

I sent a reimbursement letter to John Cardillo, the CEO of Premier Fitness at Corporate Head Office in Mississauga but no responses were made. 

So, I filed a complaint through Ministry of Consumer Service. About 8 weeks later, I met with the agent and we discussed the issue. 

Now all I could do is wait patiently and hope for a good outcome.

May I know the outcome of your complaint? have you received your money back and what are you planning to do further?

I am currently facing a similar situation and dealing with Dixie and Dundas branch in Mississauga.

I have been in contact with the person by the name of "Heena". Also, I had been in contact with two of their managers "Geli" and "Sylvia Sharpley". Both of these managers were in charge of Mademoiselle Fitness inside Sheridan Centre Mall before the fitness centre shut down.
