Pressler and Pressler just levied one of my bank accounts in the sum of $7,000. My parents, who live in Long Island have received several letters addressed to me from pressler and pressler in the past, which were returned to sender since I've never resided at that address. The phone number that is attached to the levy is in 516 area code so they're clearly pursuing this in long island whereas I live and pretty much always have lived in Brooklyn.

The last debt that I had, was charged off 6 years ago, not positive exactly when, and was from Discover card. The first collection agency (don't recall the name) got in touch with me and tried to work out a payment plan over the phone. I asked for a proposed payment plan in writing, but never received anything and they stopped calling.

At this point I haven't had any communication with P&P, and only unanswered phone calls (unanswered by me) from palisades collections. However My account is now frozen and I'll be gathering up a lot of overdraft charges. My paychecks were direct deposited, but I just switched them back to paper checks, and will be going off cash for a while, which is not that big of a deal, with the exception of automatic payments for gym membership and several other things.

Up until this morning I was ready to call and try to work something out with P&P, however after reading this website I'm no longer sure that's a good idea.

However I also have no idea what else I can or rather should do. I know I need to send a debt validation letter, i would guess to their main office. Here some questions I have at this point:

How do I fight the levy?

Should I try to find a lawyer?

Would they do a case on consignment?

Is there a jurisdiction issue at hand here at all, since they're attempting to go after me in LI courts?

How Do I find out which court and get records from that court?

1. they must have sued you and won a money judgment against you. 2. They requested an enforcement order from the court to levy your bank account. Your bank will have a copy of this order from the court - get a copy of this document from your bank. This document will tell you what court ordered the levy. 3. Contact the clerk of the court that made the levy and awarded the money judgment against you to obtain copies of ALL DOCUMENTS filed in the matter, including PROOF OF SERVICE. 4. Contact a competant attorney to resolve this matter. You could try to fight it pro se, but I wouldn't recommend that - everything you file has to have all the i's dotted and t's crossed just so or else you loose. Good luck.
