Send this debt collector and the court a letter via Certified Mail with Return Receipt (NOT regular mail) stating: Per the Fair Debt Collection Practices Act, I am requesting written validation of this alleged debt, to include: - A copy of the original application with my signature for this alleged debt - How much was this debt purchased for? - Provide a fully itemized statement for the amount you are asking which clearly details how this amount over the amount that was paid for this debt was calculated, including the interest rate being charged. Confirm that this rate falls within state usury limits - What is the Date of Last Activity being used to calculate the Statute of Limitations for the alleged debt This letter has been mailed via Certified Mail with Return Receipt. Receipt of this letter is being officially time stamped. Per the Fair Debt Collection Practices Act, cease all verbal communications with me until this alleged debt has been validated -------------------------------------- * DO NOT sign your signature on any document that you mail to a debt collector. Have you received anything from them other than telephone calls? Are they calling you at work? After 9 p.m. or before 7 a.m. (I believe the cutoff is not before 7 a.m.). If so this is in violation of THE FAIR DEBT COLLECTION PRACTICES ACT (http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf). If you have received any written correspondence from them you need to send a Validation of Debt Letter via USPS certified with return receipt.http://credit.about.com/od/debtcollection/qt/validationltr.htm If they file a lawsuit against you they can and will attempt to seek an Entry of Default Judgment meaing you will be found responsible for the debt (whether you are aware of the debt of not)! Midland's attorney here in Phx, AZ swear up and down that they served me a summons for a lawsuit back in May 2008. Currently, I am in the midst of trying to obtain a hearing as this company has ignored my request for Validation of Debt. Court can't respond or won't respond as they cannot offer legal advice. A lawsuit may not have even been filed as of yet, but do not wait to long for one to be filed. Access court records via the internet and search for your name. Call the court and ask if a civil suit has been filed naming you as the Defendant. Midland Funding is a debt collector who utilizes attorneys in their area to collect debt on their behalf. Debt that has gone uncollected by the original creditor. They buy this debt for mere pennies with the promise to the original creditor that the monies collected will be paid to them (yea right). Check your credit reports by logging onto www.annualcreditreport.com - you are allowed three free reports (one from each Credit Bureau) every year. Chances are...Midland Funding is those reports. I feel for you. I am a single mom too.

These people canot touch your wages if they ask for any imformation over the phone refuse to give it .Then if you have caller ID call your phone company about putting a block on thier#s that way they will no way to contact you or change your # and have it unlisted and ask the phone company not to give out new#
