Hopia, First of all, nobody can just garnish your wages. You MUST first be sued, and lose and then they must go back to the court and get a garnishment order signed by a judge. Even then, you can appeal this order for hardship purposes. Each law has different exceptions and provisions for garnishments. NEVER speak to ANY debt collector on the phone!! This will NEVER produce positive results for you, and will always make things worse. STAY OFF THE PHONE!! You may have screwed yourself by making an agreement to pay. This is legally considered to be affirmation of the debt. This is what they hope for. What "consent" letter are you talking about? WHAT did you "consent" to? The debts they collect are usually past statute of limitations and are NOT legally collectable. That is why they trick you and harass you. Because they know they cannot legally do anything else.

Yes you can if you have all your documents! Not the one you replaced as Pressler will have a copy but all your evidence that you are right!! Good Luck! You need to file petition in Court to reopen!
