Recently I bought a car from a used car lot. They brought in this guy from GMAC, and he got me lined up with insurance for $130.00 a month. A month later I get a bill from Progressive Insurance saying I owe them $330.05, for 1 month.

So I call them up and they tell me the guy that helped me to get insurance has recently been fired (something also about pulling another trick). Then they said they would have one of the two other agents call me back. They never did. I've tried to call back, and either no one answer, or no agent is there to help me.

This last Friday the 24th of June, 2005, Progressive Insurance did an Unauthorized withdrawal from my checking account for $560.54. I'll repeat, UNAUTHROIZED WITHDRAWAL FROM MY BANK ACCOUNT FOR $560.54.

So I call them up rightaway, and they tell me that it was for May and june, and that they're not going to give me my Money back. I said "WHAT", I told them that it was unauthorized, but that made no difference to them. They must be hard up for my cash.

So I told them I was done with them, and I no longer wanted their services, and I hung up. Then I called my bank. I set up a dispute, and I guess I'm waiting to see what is going to happen.

Am I going to get my money back?

How can they LEGALLY raise someone's rate, and not have to let them agree to it before continuing services with them, and than just go and take the money from them anyways?

Is this something I need a lawyer for? Or can the banks, or you guys help a little guy from getting stepped on by the bigger guy?

I've seen incidents like this before, here's what you need to do: First, understand the agent that sold you the insurance does not work for progressive. He is an independent agent and can sell insurance from any company. He was most likely fired for fraud. Independent agents have tools which can give you quotes from different insurance companies on the spot. They are designed to give a quote that is accurate most of the time, however they don't always have the tools to accurately verify information such as your driving history. The rate they give you is still subject to change as once the agent submits it to the insurance company, they verify that all the information (driving record, vehicle/insurance history etc.) is correct. If it is not correct, the carrier will adjust your premium. The agent most likely pulled a bait and switch on you by changing your information before uploading it to Progressive so that he could show you a more attractive quote. (this type of fraud is unfortunately, very common) Once the insurance company verified and corrected the info, a new premium was issued. TO OBTAIN RESOLUTION: Your best bet is to IMMEDIATELY contact the office this agent worked at. All insurance agents are required to carry Error & Omission insurance. Ask them whom their E&O carrier is and call to file a claim. Call Progressive, and ask if you can get a copy of the information that was uploaded from the agent. See if you can dig up any papers you filled out to check for discrepencies. Be sure to inform the E&O carrier that the agent was terminated for fraud. If the agency refuses to give their E&O insurance carrier's name, tell them you will report them to the insurance commission, then do so. If the E&O company won't pay, do the same. The claim is small enough that they will likely pay it just to keep you from putting a complaint on their record, as that puts them at risk of hefty fines. Good luck!
