My developementally Challenged brother, he & I have lived together, and I supported him with caregiving for the pass seven years, plus. He was hit by a driver last November, 2008. My Pastor referred me to get Richard Breen to represent my brother's case, I did. The settlement check was issued in March, 09. Richard Breen and his asst., Adam Redden are trying to make us put my brother's remaining money into a trust with stipulations of use. At that time we were pressured into considering Richard and Adam's directions of getting a trustee. My brother was in a rehab facility and I took ill, I was concern about his well being and how was I going to get him back home and able to get him the proper care. I'v asked and was rejected by Richard Breen, of my being my brother's Trustee, when I got rejected, we asked if our Pastor could do it{ agreedment of my brother & I }.We were turned down. Then we suggested another attorney, 1st. he was too ill to do it then months later he excepted; it would cost another $2500.00 for an outside attorney {choice of Richard Breen's} to take the case, for the appointed lawyer to take it before the Judge. My brother and I rejected their complete 'getting a trustee' offer. Now since I am my brother's payee, and support caregiver, have been for years; He & I told Richard Breen several times that he want me to handle his money and affairs. My brother was getting support from medicaid/medicare; both have been reimbursed, I have the (cc) letters that was also sent to Richard Breen & Adam Redden. Today I received a reply email from Adam Redden saying to wait more till they contact Medicaid to see if they want their name on the check with my brother's name (?). I am not understanding; I got Richard Breen to represent my brother's case, how is it legal for them to hold up sending him his check (?). This complaint was only recently discovered. The complaint contains false information. My firm is now in receipt of a written ethics opinion from the Kentucky Bar Association authorizing us to deny the factual accuracy of the complaint. Regrettably, pursuant to the Kentucky Rules of Professional Conduct we cannot disclose information relating to our representation of this client that would enable us to rebut the false statements in the complaint.
