Description of Violations:

Not sure about code violations because none of the engineers/inspectors have said so specifically, but we have serious foundation failure, roof defects, a suspected break/leak in the sewer line, a sink hole, and doors that won't close.

Description of Problems:

Foundation Failure, Sink hole, house needs piering on one side, soil is heaving under slab on other side, doors won't close, roof is coming apart...That's just the major stuff. It took six to eight months of complaining to get the builder to fix the minor stuff, like screen door, etc. Builder and warranty company pass the buck. Now the warranty company wants us to go to arbitration with their own hand picked arbitrator. None of them will put in writing a plan of action for repairs, all we get is verbal promises that no one shows up for. We've taken time off work, and this is really my job now, to deal with this. We've written many letters, including to BBB, etc, with no real results. Trying to avoid a legal battle. We just can't afford this, but can't afford to give in either. It's extremely stressful. HELP!

Update:

UPDATE of existing complaint on HADD: Despite Fuller's denial of it, the grading has been found to be seriously incorrect by about five engineers now, including those sent by the warranty company, HBW/NHIC. Also, none of the experts who have written reports on our house have been able to find any sign that the required roofing felt was put on our roof under the shingles.

UPDATE of existing case on HADD: The home's defects include improper grading and drainage, foundation failure, doors and windows that are not operable, roof leaks, and above code violations. We cannot fully use our home, and have been at this almost a year and a half now. HUD says the builder is in direct violation regarding his refusal to honor the warranty. We have filed complaints with the atty gen, HUD, etc. Recently, an online complaint we have on "rip off report" where we have stated our case truthfully, rationally, and without exaggeration, has recieved three nasty rebuttals from someone we suspected represented Fuller. Now, they have admitted they do work for Fuller, and here is what they said to us:

"It seems that people these days are increasingly hard to please. People want everything perfect and once it is their still not happy. I doubt "Rip Off Report" will show this rebuttal. I am a sub-contractor for Richard Fuller Homes and various other builders. I know about this site from listening to homeowners that I do warranty work for. If you think this is effecting their business, you are sorely misguided. By my best guesstimates, Mr. Fuller probably makes 10-20 million per year off homebuilding and other investment interests. He can afford to completely ignore people who choose to take extreme measures like this. Most every builder has complanints on this site and they also have no intention of responding to these complanints. I see both sides of the story. I think Fuller is wrong in some areas as well as homeowners. I as a contractor build a quality home for them. The home is safe and structurally sound. I will admit their warranty dept leaves a lot to be desired. I just want you people to know that the employees of that company know about this site but give it no consideration. Richard Fuller Homes is in Texas to stay. They have a multi-million dollar investment in land and development. Although you may cost them 1 or 2 customers, too a builder that builds 300-500 homes a year in Texas alone and near a 1000 a year in New Mexico you are not costing them a dime. Im also sure by my own opinion that Richard Fuller Homes will never settle with Cindy whatever in Oklahoma. She is a wack and nothing more than white trash. Thats my opinion."

Now, if you or I said these things to someone we'd arrogantly and deliberately admitted to have breached a warranty with, we'd probably be in jail. No one can tell me builders are not protected by the very gov't agencies that are taking our tax dollars and allegedly protecting consumers rights.

I want everyone to know that the new city of Burleson Police Chief who came to us from the neighboring city of Cleburne decided to walk out of his contract to purchase a Richard Fuller Home when he talked to several of his fellow city employee inspectors who told him he would be making a bad decision. They went on to tell him of the severe foundation problems Fuller was having in the Castle Hills subdivision in Burleson That was the subdivision he was hoping to move into. He had left a $1,500 deposit and had paid for about $10,000 in upgrades. He walked away from this amount of money because of the problems. Thats courage folkes!
