I have worked for my father for about 10 years now. My father has been a hard surface flooring installer for over 25 years so I can say with absolute confidence that my father is a professional through and through



We recentley started taking jobs out of small shop called Austin Bluffs Flooring. We completed five or six jobs without any problems untill the last job we took. The job went off without a hitch, that was until after we left. We got a call later that night saying that the supply lines from one of the toilets removed & replaced had broken and flooded the bathroom. (They said it ran for 10 min. unchecked so maybe 10-15 gal. of water)




This has never happened to us before. We saw the line and it wasn't broken no one really explained to us how it happened and we, the shop included, were dumbfounded. Anyway there WAS water on the floor and the damage had been done and since we were the last one to touch it we took responsibility. We called our insurance company , they called in the repairmen, we paid the $500 deductible to our insurance and they paid the customers $1,100, and the shop got $900,everything was fixed. After all of that Roy told us that the job broke even and that he wasnt going to pay us. WHATEVER. We thought we were done so we walked away.



This is where the Problem started:       



Austin Bluffs Flooring went to collect the money from the customer. The salesmen offered the customer $250 (of my fathers money) as a gesture. The customer declined and then wrote a check that was $877 short of the total bill. When the ask what the reason for this was the customer said that this is how much they owed HIM because he had to stay home and watch all the repairmen. He called it a "forced loss".



So without another word to the cutomer, as far as I know, Roy D. turned around and automatically assumed that the difference needed to be made up my father. So after eating three days of work paying $500 to insurance.. even after the customer AND Austin Bluffs Flooring getting paid off... Roy D. still wanted my father to pay the difference.



My father tried to make it right. He offered to work it off or pay it off... Roy D. said no he wanted it all at once. My father couldn't do it so he said no, so NOW Roy D. is taking my father to small claims court to try to get it.



We were warned about this guy Roy but never imagined that he could be so unsrupulous.



We were warned by former employees who had left earlier because of Roy. Last I heard they were going to take Roy to court because he refuses to pay them the money that he owes them.



my fathers court date is Nov. 14. I will post an update of the results.

Customers Letter: INSTALLATION ,Due to the low quality of workmanship on the baseboards and their unprofessionalism, I will not accept the same contractor to remedy this work. For example:Poor attitude throught the project, Complained about removing tile in front entry,On thursday, told my wife at 2:30 pm that they were done for the day, delaying the completion of the project, Stated they did not have enough material, but left same material in my garage. All of the baseboards are unacceptable due to very poor workmanship.

FLOOD; Due to your installers actions on 7-16-09, the water line to the boys bathroom was improperly re-installed (It should have been a new line) resulting in a flooded boys bathroom (2 nd floor) evident water on the floor in the adjacent master bathroom, water standing on the upstairs hallway carpet, water pouring through three electrial appliances on the first floor (a smoke detector,powder room fan and a canned light in the ceiling),and water in the storage area in the basement. We used towels,buckets and rugs to capture the water.

The main power and water service was shut off and a emergency plumber was called. Please contact us at your earliest convenience to correct these issues.Upon successful completion of the project, I will pay the remaining of my bill minus my incurred cost.

Austin Bluffs Response: Full action was immediatly taken to correct the installation problems and also the flood damage problems. This consisted of a Plumber, Electrician, Water Rescue Service,Carpenter, Flooring Installers and many extra hours for the Homeowner as well as Austin Bluffs Flooring.   Roy Davis  Manager, Austin Bluffs Floors.

Not understanding how Austin Bluffs Flooring would owe funds to a retiree.  Mr. Davis hasn't been employed since Digital shut down in Colorado Springs in the early 1980's.  If you don't have a job, are not gainfully employed, how is it that one is inconvenienced in that they had to wait for a plumber?  Nice question to ask the judge.

P.S.: Better have that Return of Service filed with Magistrate Winegrad.  If not you'll have to start over.  Make sure you have copies so that your records get to the Division on time.
