RE Contract No. 49-83291

Bought November, 2004

We have not been able to work out any sort of compromise, as you still have stonewalled both me and the Better Business Bureau. It has taken far too long to reach any sort of compromise, unfortunately, and we have been unable to arrive at any reasonable accommodation with you and your company. Your office has not kept me informed of major changes to my account, you have given the Better Business Bureau the run-around, and you sent me to a Mexican representative on a wild goose chase.

I am aware that my right to cancellation and a full refund is non-waivable, - the buyer cannot give it up- and even if I was convinced to sign a document to give up my rights, that waiver is not valid and I still has the 5 day right. Any argument you have claiming that my deposit is non-refundable, regardless of any misleading information or statements you put on the purchase agreement that my deposit is non-refundable, is also invalid according to Mexican law and this has been verified with PROFECO. Mexican law allows me to cancel for no specific reason and requires you to provide me a full refund.

I have been in contact with other Americans and now know what my rights are under Mexican law. If you plan on sending me an email refusing this request; do not waste your time or mine. I am not interested in any negotiations or cheaper packages. I immediately want this contract cancelled and a full refund of all my money. You must comply with this request by law or face fines.

Comply with the law, cancel my contract, and send me my refund. You should also note that I am copying several Mexican and US government agencies on this email (complete list found at the end of this document) as proof that I notified you as well as to institute a process here to get to you comply.

----------------------

I also have a link to a very good article online about the whole Royal Holiday Club scam here at (((Redacted)))word-is-getting-out-that-royal-holiday-timeshare-is-fraudulent-operation I want my full refund from RHC. There is no statute of limitations on fraud and therefore on refunding of fraudulent gains.

I might also add that liquor was freely available even before noon on the days that RHC reps were wining-and-dining victims into signing. They also made false claims about awarding me bonus frequent flyer miles and about giving me not one but TWO free bonus vacations to the locales of my choice. These promised bonuses were non-existent and the reps will lie any lie to get victims to sign the papers.

The fact that they operate on the grounds of major hotel chains gives them an aura of respectability, but a lot of people have to be looking the other way in order for RHC to operate for as long as they have.

I have never been able to get even one vacation at this timeshare. It is very difficult to even get any response by mail.

Another problem is that when you first meet with reps from this company, you think that you are dealing with an American company because they give an Arizona address. This is misleading. You will be dealing with Spanish-accented reps, and who knows where they are. They may be in Miami, they may be in Mexico or they may be at the Puerto Rico office at: Condominio Puerta del Condado

1095 Avenida Wilson Suite Pt.

San Juan, Puerto Rico 00907

Ph: (787) 721 3636

1 866 944 2525

1 800 961 1810

Fax. (787) 721 3682

(I have given the Miami and Mexican addresses above.)

Good luck to anyone else who is trying to get money back from these master scammers.
