My problem with Salliemae stems from in 2002 I had a forbearance on my student loan account that had been transferred to them through a merger(lucky me). The account was in forbearance from 03/2002 to 10/2002 due to financial problems. I still have all the letters from them confirming this by the way.

Well in July of 2002 I lost the very low-paying job that I had and was forced by Sept. 2002 to file a chapter 13 bankruptcy to prevent my mortgage company from forclosing because we fell behind in the payments due to job loss.

Well my student loan that was serviced by this company this entire time was in forbearance. According to Bankruptcy laws student loans are supposed to be deferred until the chapter 13 plan is completed in 09/2005.

I know that my lawyer notified them because I never heard anything from SallieMae in 10/2002 or afterward. I of course did not find out about this until I decided to go back to school last month and found out that I could not get any student loans because of a default.

I pulled by credit reports and low and behold SallieMae had reported me as defaulting as of 11/2002. They are claiming charged off. It appears that they sold it to another servicing group but failed to notify me about this.

The account was sold to USA Funds in 10/02. Same month as my forbearance expired. Sounds like SallieMae is a bunch of liars.

Furthermore, I have never heard of or from this other company but they are listing me as deferred due to the Bankruptcy. So something very unkosher is going on at SallieMae.

How could I have defaulted if in forbearance? How can they legally on my credit report say they filed a claim with the federal government? How can I have defaulted when they sold it to another servicer reports me as ok.

If they had filed a claim then the last time I recieved a refund in 2003 I would have not recieved it.

I just might sue SallieMae over this I will have my Bankruptcy attorney call them. I have disputed this with the credit bureaus as well.

I feel that SallieMae is treating me in an unlawful manner because of filing bankruptcy. I never defaulted on any of my student loans. Sallie Mae is a rippoff avoid at all costs.
