Drug tests, and especially those that are taylored for the trucking industry are extremely sophisticated these days. You described the process well, as to how you were ultimately found to be positive, but there's something missing from the equasion. First of all, there isn't a food on earth that you could have eaten that would have resulted in a positive finding for THC. The day has long since passed when poppy seeds trigger false positives. I personally tested this one myself inadvertantly, but I tested clean as a whistle. About the only way to trigger a false positive, would be a case where you were in a room for a rather extended period of time where some heavy pot smoking was occurring, and to then be tested within 24 hours. In that case, it's a matter of opinion as to how innocent someone might be, because I know the risks of being anywhere near people who are using drugs, and I don't want to be implicated in any manner, because my job hinges on clean drug tests at all times. If you were in a room where it was being smoked, you definitely inhaled what was lingering in the room, so how could anyone prove they didn't actually smoke it? But, because I truly don't know what triggered your positive result, let's assume you are completely innocent. What I am about to offer will not help you, but it may help someone else who may be faced with the extremely rare instance of an inexplicable false positive. When you came up positive, your immediate FIRST action should be to counter any evidence that you are positive. You inform the MRO that you intend to submit evidence to him ASAP to prove the there is something amiss in what he has in front of him. Request him/her to give you long enough to submit yourself for more through testing to any standard that he/she sets forth to counter this (24-48 hours), and ask him/her if there is a facility near where you are that he would trust to collect any and all evidence for more extensive testing. If he or she refuses, there's not anything you can do but to take things into your own hands to begin to fight this to the bitter end. That mean you head to the nearest facility to where you are at the moment, that can test you thoroughly for any evidence that you have used any drugs. This means testing by means of oral swabs, hair analysis, and blood tests. Make sure they are aware of and follow all of the USDOT standards for drug testing. You pay for this out of your own pocket. You MAKE SURE it is conducted in the same manner that any testing for drugs would be done, even if that means someone witnesses everything you do. You make no requests other than for all information as to the test results, to be sent directly to you in original printed form. Assuming that the results are in your favor, and there is not any trace of any illegal substance in your system, you send copies of the results to the MRO who evaluated you as previously being positive, your employer or former employer as the case may be and request that this be inserted in your qualification file, to any MRO that you may be seeing to reclaim your drug free status now or in the future, and then you immediately seek the advice of an Attorney to represent you in clearing your good name. Furnish the Attorney with copies of the results. NEVER let the original test results leave your possession. Save them for any court proceeding as proof positive of your innocence. Make no mistake. Even after having done this, the MRO and the company may totally discount what you have done and ignore it completely, but it is a step you can take to go the distance of clearing your name and record. It may well cost you thousands of dollars, but with NOTHING to counter the original random urine test at all, you have no way under the sun to begin to fight a false positive. And as I offered earlier, false positives are so rare in the year 2007, the odds of winning the largest jackpot in lottery history are better, despite what can be read online at various websites. The tests are that accurate. Trucking companies are under strict guidelines to keep drug users from behind the wheels of trucks, and they cannot take chances with anyone that tests positive. Very few will even take the legal steps of returning someone who has tested positive, as provided by the FMCSA. It's too risky. Insurance companies will often refuse to insure any driver who has tested positive within a certain number of years. Five to ten years is standard. Daniel, if you indeed are innocent, it is unfortunate what has happened to you, and I urge you to fight this to the end. No one deserves to be branded a drug user if they truly have not been using drugs. If you are not innocent, then justice has already been served. There is no room for drug users in large trucks. It's bad enough when they drive automobiles. So, if you do desire to drive a truck again, and you are absolutely innocent, you have a long and winding road ahead of you. You need to consult with an Attorney immediately to see if there is anything that can be done to exonerate you and get this erased from your record.
