On May 1st of 2000, My wife took my Van to SEARS to have one tire replaced. While SEARS had the van on the lift, they allowed an employee to drive a Jeep into the shop. It turns out that the employee did not know how to drive a stick shift, and he lost control of the Jeep, knocking over an engine anlyzer, the tool box, and My van up on the lift. My van fell off the lift onto the Jeep roll bars and rolled onto the floor. The damage that was done has completly Totaled my van.

When I arrived on the scene, the garage manager told me what happened and then told me the employee responsible did not know how to drive a stick shift and he apoligzed for the incident.

The inspector from SEARS who came out to look over the damage, was smoking a ciggarette the whole time he walked around the vehicle. The Manager of loss prevention who took a full report,refused to give me a copy, when I asked him for one he replied "no Way!"

I have written numerous letters, e-mails, phone calls, and have attempted to contact SEARS for over a year and NOT ONCE has ANYONE from SEARS EVER! returned a letter phone call or e-mail.

After consulting with 18 different Attornies I still have not gotten ANY settlement from SEARS. They have ignored the entire incident and treated me as if I don't exist.My Van Was assessed by two different insurance companies, and valued at $18,000 to $22,000, and I have recieved NOTHING from SEARS to compensate me for the value of my van!

My next plan of action is to send this story to EVERY E-mail address in the country and see how they respond to that. Otherwise I am out of options with attornies and with SEARS.

Rebuttal:
How could an engine analyzer have run into this persons van? Sears has been out of full service auto repair for MANY years, and all of their anylizers have been sold. (fact). Used to work there.

This sounds like a typical disgruntled ex-employee. After a damage report has been generated, it is then out of local, regional and corporate managaments hands...an insurance company is then in charge of handling the claim.

It's ridiculous to get mad at Sears, when your attorney should easily be able to reach a reasonable settlement if your claim is in fact true.
