A perfect storm is brewing for Sedgwick and AT&T.

I and many others feel the pain of MentalTorture (another poster regarding this topic), especially those of us that are legacy AT&T (prior to the SBC merger).

The flagrant ERISA violations that I experienced, and that I heard about from several others due to the switchover from MetLife to Sedgwick, is mind boggling. There is only one possible conclusion to be drawn from what I have observed so far; either they are simply not capable of performing competent claims management on all their cases, or they are engaged in calculated efforts to terminate claims, legitimate or not. IN EITHER CASE, THIS IS A SERIOUS VIOLATION OF THEIR FIDUCIARY RESPONSIBILITY AS OUTLINED BY ERISA.

Do they not think we will find each other? Do they think that such flagrant and wholesale abuse of the members of the AT&T plan will go unnoticed? Do they not recognize that the poor financial management from the amount of money they spend of unethical physician advisors, excessive harassment of claimants, and other wasteful practices can clearly be construed as a breach of their fiduciary responsibility.

In the DIP SPD it is clearly states:

In addition to creating rights for Plan participants, ERISA imposes duties upon the people who are responsible for the operation of the Plan. The people who operate the Plan, called Fiduciaries of the Plan, have a duty to do so prudently and in the interest of you and other plan participants and Beneficiaries.

Personally I cant wait for audits that will result from the inevitable class action suit. Prudent management of plan assets does not appear to be high on their priority list.

A perfect storm is brewing for a class action suit regarding Sedgwicks fiduciary behavior. Unfortunately for AT&T, if they continue to condone Sedgwicks behavior, they too will be held accountable regarding their own fiduciary behavior.

They closed my disability claim... blatantly, absurdly ignoring all relevant facts. My doctors repeatedly X'd through their computer form.. and put in-writing that my medical condition is too poor to allow ANY kind of employment. They kept repeatedly re-wording the same question... and pretending that they didn't get the answer they didn't want to hear before. They ignored the evidence supporting my claim... for the "badgered and pieced" evidence they were trying to support. They kept pretending there was no communication between me and my doctors... and tried to pit me against my doctors by being dishonest about what was in my medical reports (not knowing that I have a copy). If you are interested in class action - (((ROR REDACTED))). I have a video on youtube search for "PokeStir" and AT&T I would like to see a class action with SERIOUS punitive damages... in the billions... or even a 2nd breakup of the corporation as they are abusing the legal system and their 800 lb gorilla status.
