About 2-3 hours after eating at a restaurant, both my wife and I got food poisoning. I submitted a complaint on the restaurant’s website and after a brief conversation with the manager, he opened up a claim with Sedgwick to handle it. 

I was contacted last Friday for the claim lady to gather my details. 

Here's the details: 

Both my wife and I had 2 different chicken salads and 2 different beers. 2-3 hrs after eating, we both became violently ill, throwing up the whole night and a little the next morning. I even had to take Monday off work because of how ill I felt. I did not go to the hospital because it wasn't an emergency. I read that if you're throwing up for 3 days, then you go to the hospital.

I got a call back from them today (Tuesday) denying my claim, citing that the internet says it can take up to 48hrs to get food poisoning, and we don't know what else you ate in the last 48 hrs. After ridiculing them for using some ambiguous website for that information, I did my own research to discover that food poisoning occurs 2-6hrs after eating.

I proceeded to file a complaint with the local health department to handle the issue.

If the restaurant just gave me my money back, this issue would be over, but the principal of telling me I'm wrong after being ill for 2 days and taking a day off work is not okay.

While it is the job of companies like this to deny..deny..deny.  The fact is that in this case you have no proof other than your word that not only did you have food poisoning but that this resturant was the cause, and the fact of the mater is with the number of people trying to run various scams(and I am not saying you are one) companies want proof.

First of all I really don't know how much research you did to find an article that states Food Poisoning can occur in 2-6 hours.  Of course you failed to notice that it said "most" occur in that time.  It stated there were some that took a shorter amount of time and some that took longer.

The article you should have been looking at is from the FDA..that is the FEDERAL DRUG ADMINISTRATION who also handles a lot of food safety issues.

You will see that there are several common ones such as Salmonella that can have the symtoms appear anywhere from 6-48 hours.  Or one like E. coli that can be 1-3 days.

Now, your problem is that you did not go to a doctor who could have run simple tests to determine not only if you had food poisoning but the type you had.  Part of these "tests" also as standard procedure will include having you determine what you have eaten in the last 1-3 days.  The reason is that if other people start to come in with the same symtoms they can start to piece things together and perhaps find the exact cause.  As any case of food poisoning is reported to the local Department of Health.

Now, if the tests showed you had one that did manifest itself in 2-6 hours you would have had very good proof that they were probably the cause.  Just like if you had a type that took 12-48 hours, they would be ruled out.  But since you did not go to the doctor you have no proof.  Trying to get this insurance company to pay on your claim, is like telling your auto policy you had a car accident but refusing them to see the car or get an appraiser to look at it.  Without proof..they aren't going to pay.

A few other things. 

You stated you did not go to the Hospital because it was not an Emergency.  Okay..perhaps not.  But then why didn't you go the next morning to your regular doctor?

Also, do not be surprised that if the Health Department follows up with you that they don't at least inquire about what else(and where else) you ate in the day or two before you got sick.
