I have tried to refinance several times as my mortgage was sold to Select Portfolio. I have an interest rate of 7.75! This can't be legal! At this time of life I do not  need the headaches nor the aggregation of dealing with people who want me to SUFFER and eventually lose my home! Some country America!  I would like to participate in the Class Action Suit. The NMLS search proves SPS is not licensed in Nevada. What they did on my mothers home then is use US bank Trust NA to foreclose and put the Utal SPS address under the US bank Trust NA name. All documents recorded include my name but none of it was ever on my credit report and SPS refused to talk to me. Mortgage Servicer License This license will become available in NMLS starting December 24, 2015. When SPS foreclosed it was Jan 15th 2016 and they didn't even warm me. There was no Trustee Sale and no default recorded.  All previouse Trustee sales recorded only had National Default Reconveyance Company (NDSC) and no Bank Beneficiary or servicer listed. Tiffany & Bosco created NDSC to steal homes. Mark S. Bosco is behind all the fraud. http://www.nmlsconsumeraccess.org/

I unfortunately have to contend with these pieces of dog s*** as well.  FOr over 10 years I have been dealing with Nonsense with them after Washington Mutual, who then becam Chase, sold my account to them, Shame on Chase, they are the ones who sell of the business b/c they cannot handle the business they have.  Possibly if Chase would not have been so swift to buy up all of the other smaller banks, maybe SPS would not exist? Possible I think, however I wanted to tell you if you truely are serious about filing a Class Action, I am all in at 100%!

I was wth  CitiMortgage for (9) years they handled a modification loan turning my Fixed Mortgage back to a Arm and sold my Loan to Select Portfolio Servicing, Inc.  I did no or understand why my monthly loan payment  with SPS moved from 1092.00  in a year to 1344.00 monthly.  They informed me that was the contract they had with CitiMortgage, I told SPS that I was no longer interested in saving my home under these conditions. I filed a complaint with Consumer Financial Protection Bureau against CitiMortgage and arranged for help from their home ower hotline. The counsel from home owner hotline and myself contacted SPS telling them that I wanted a short sale or a deed of lieu to foreclosure. Finally after several tries they granted me a Rasmus Realor who came out to my house took pictures and placed me on Zillows so my house could be publicly seem. Once my 120 days was up stated by the law, SPS send me a letter stating that they never agreed to a short sale and had Rasmus Realtor to pull my house off the market.  I then Filed a complaint with Consumer Financial Protection Bureau against SPS. December 7, 2015 SPS send me a letter stating that I can continue to work with a real estate agent to complete my short sale. They also stated that my account has been assigned a relationship manager to assist with the resolution process.  I am now asking for a deed of lieu to foreclosure in order to get on with my life. I am still being asked as of today to send in documentation to support my case.

Select Portfolio Servicing took over my loan from Chase just over a year ago and it's been a nightmare ever since. Incompetent handlin of paperwork during my loan modification. Being misled in regards to how my property taxes are being paid. Mortgage increases, etc. etc.

These people are corporate crooks and I cannot believe they can go on acting so unscrupulously and not be checked by the powers that be. To make along story short sps took over my mortgage from chase in Sept. 2013, from the very first month they said i owed them 14,000 dollars back mortgage payments (which i did not) ive been fighting them every since on that matter, they offered me a modifacation if thats what you want to call it "2300 a month for the next 20 years and then a balloon payment of 250,000 dollars yes i said 250,000 dollars " my loan is only 370,000 dollars, when i was with chase my payment was only 1,170 dollars a month, i really don t see a modifacation if you doubled my mortgage payment and made it so that i will never be able to own my home they are literally trying to take my home away from me, i so need to be a part of this class action lawsuit please contact me [email protected] my name is ron

BB&T sold our loan to SPS back in Oct/Nov 2014 and it has been a nightmare ever since!  Not only are they claiming we are a month behind (all paperwork, bank statements, etc has been sent proving otherwise) they paid a tax bill that was not due and was just paid out of escrow and demanded we refund them by adding $150 to our monthly mortgage payment.  We spend entirely too much time EVERY month with this company trying to resolve this and they are unprofessional and give us the run around.  This month they would not let us make our mortgage payment unless we paid the $150.  The issue here is that the county is refunding them the money but not as fast as they would like so they are passing the cost off on us.  They have agreed it was their mistake, but refuse to simply wait for the refund to come from the tax office.  BB&T has sent information to them showing we were current and we have not missed a single payment but every month we pay, they apply it to the previous month.  I am 100% in if someone contacts me about a class action suit; the mental anquish alone justifies putting this company out of business.  I can't believe the BBB has allowed this to go on with all of the horrible complaints from people across the country dealing with them.  We have no problem refinancing with another company but the value of our home went down with the housing market so we can either walk away and let them have the house or they would have to agree to take less then they say it is worth; and they will not do it!  There are so many complaints from others about this exact issue!  Please someone do something to help consumers who have done nothing to be treated this way!

My Mortgage was sold to Select Portfolio by Bank of America. My interest Rate is 7,75 percent. My account told me on my last Income Tax Return I paid $35,000 towards interest.!!   None of my payments were toward the principal. I am seventy years old I will never own my own home as most of my payment is going toward interest and very little money is going toward the principal!!! What a scam. 

I am going to refinance. I am having a horrible time getting these criminals to release information to me . Why would they want to help??? I am acash cow! I want to refinance and perhaps obtain home ownership before I die!!!

 My interest rate is outrageous! BETWEEN 10% AND 12%!  Sebring Capital sold my loan to Select Portfolio Servicing without my knowledge or consent.  My loan amount has increased over the last 15 years, by over $5.000.00, with nothing being paid on my principle.  I am elderly,  and disabled, having endured a divorce and am afraid of loosing my home.  It father aggravates my medical conditions, knowiong at this rate, I will never own my home, or have anything left to leave my children when I die, but this debt and that they may endure the same conditions. The hopelessness of it all is overwhelming I am very frustrated and do not know what to do to resolve this situation.  My depression is intense. Please suggest some resources that may bre able to help me.  There must be some help for people like me. 

PLEASE INCLUDE ME IN ANY CLASS ACTION LITIGATION AGAINST SELECT PORTFOLIO SERVICING.  I do not feel that I am being treated fairly.  Had I understood these terms, I never would have entered into this agreement.  It has made my golden years a true struggle.  I simply myust have some help and relief of this debt.

I wonder if Chase had any authorithy to sell my loan to some third party of whom I have never heard about? Is there any legal action against this? Well it started when our account was sold to them from Accreted Home Lenders.  Our first bill jumped by $300 per month.  When my husband called to find out why he was told "because it did".  REALLY??  Our taxes had gone up but not by $3600/yr they only went up maybe $100 on the year.  So why the $300 jump?  We continued to pay the amount we had been paying the other company for the past 6 years untill one day they told my husband "we will not accept payments unless they are made in full"  my husband explained to them that he was paying the full amout we had been paying untill they could explain the $300 a month jump in payment besides "because it did".   They told us we could try and "modify" out payments and walked us through the process.  Ummm thought a modifyed payment was suspposed to help make payments manageable no ours was going to go up over $600 a month. I could keep typing for hours on all the BS they have put us through but I would rather talk to someone who is going to do something about these CON artists. PLEASE ADD US to the list of people who want to file a class action suit against SPS.  Thank you.

I too have been scammed by these artists. My first statement from SPS requested an additional $1200.00 on top of my regular mortgage payment with no explanation as to what the additional costs were to cover. I have attempted several times to get a corrected statment and for 3 months have gotten nowhere. I don't get it. But from what I have seen on the internet, countless complaints from various consumer affair websites tell me that I am not alone. If there is truly a class action being started, I want in and I want to know what I can do to help. I am retired and cannot afford to be taken advantage of and have the time to put forth the effort to represent those being taken advantage of by this crooked company.  In the spring of 2012 i called select portfolio servicing and tried to resolve the issue at hand. Like millions of Americans, we were willing to deal with the run arounds. The second time i called, a representative told me the house had been sold. This was not true. Prepared.for the worse .we decided.to let go of our lawyer in the case. We kept trying to contact a real estate agent who was sent by them (to intimidate us). Left messags with no luck. On June of this year we saw our house in an auction site. Someone bought it and now we are figuring things out however we must. This should of never happened. I even wrote to the Attorney General's office and they sent these people a letter. That was followed by a letter to me in which they claim that my attempt was a few days after they asked me to. They made a mistake because the date i called was before then and its on the letter i have. They cannot get away with this. We never intended to be there without payment, we kept expecting an investor to show up at our door who would hopefully work with us on a least or rent to own but that never happened.

My Morage was sold to SPS fron Chase in Febuary 2013,  I had a work plan with Chase before the sold it , SPS told me that they would honor any plans that Chase had in Place after a few months SPS told me that they could not find in documention from Chase and that they could not honor the rangement. They told me to submitt a packet for a Loan Mod that they had many programs that they could Help me get my payments back. I submitted my packet my claim they didn't get the all the informatio, The kicker is that the only way that I found out that I needed the informaion was when I called them, They never once since a letter or contacted me to let me know that something was missing.  When you call you never get the same person. They strech out all the responces for 90 days then they want you to resumit your packet again. They expalin that they are try to help you with HARP or other Load Modifications but when it fails they have a plan for you to come up with a ton of Money.

I'm not saying there is anything wrong with any of your complaints but you need to be aware that class action law suits do not benefit anyone except the lawyers.

They are VERY expensive and even if one is approved, goes to court and wins, do not expect to get more than a few bucks from it.

I have been a party in a couple class action law suits. In one I got a coupon for something worth about $5.00, I don't even remember what it was.  The other I ended up getting about $30.00.

The original one to bring the suit gets some more but that's it. The lawyers get everything else.

I'm just saying, don't have any big expectations from one.

We joined a HUD class action lawsuit against Fairbanks Capital, who is now Select Portfolio.  They stole over 5K from us and because there were so many victims, out of a 40M settlement, we received only $186!!!  In my opinion, our mortgage should have been reduced by the amount they stole from us!  Once you sign a class action, you agree to accept what you are given.  The lawyers are the ones that benefit from a class action because all of their expenses come off the top.  Please seek your own attorney and fight them!  We ended up refying to finally get away from this preditory lender.  If you have to remain with them, be sure all monies sent are by certified mail so you can prove they were sent on time.  It is sad when the Federal Government has to sue a company!

David Bundrick  can be reached at [email protected]  live in Texas SPS was working with us on short sale as they had uped our payments to the point we could not pay.  Tried the programs but they kept telling us we did not qualify.  Set price on short sale was less than 80 thousand.  they told us no more interest or pen. while this was being processed.  House burned down in Nov. of last year.  Price went up to 87 thousand and they started charging interest and penalities.  Insurence paid off in Jan. this year SPS attorney had payment sent to them.  Cashed without our signatures kept about 15 thousand for himself and after 45 days released the rest to SPS. Who during this time clamed they did not know who this was or where our money was. I had to send them copies of the cashed checks.  They charged me interest and penelties on the time they had the money in their account plus reg morgage payments and sent me 37 thousand.  I feel I am stilled owed 20 thousand dollars.  This is just another rip off in a long line of rip offs by this company.

Select Portfolio Servicing opened on escrow account in 2011 to pay my taxes which I've been paying ever since on 2-11-2014. The City Of Utica Urban Renewal Agency POSTED a notice to VACATE property by 3-31-2014 at that time I had contacted SPS to find out why my taxes weren't paid there reply was we sent you a letter of denial in Dec 2013 for escrow modification I told them I never received any letter(s) stating of such if I did I would have taken action to resolve this before it escalated to this point also asked why it took 3 years to notify me of this. There was no response to that question just to fax a copy of the notice to vacate to put in for review. Which I did on 2-11-2014 but took then till 3-18-2014 to send a conformation letter to my fax that it was still being reviewed at this point my house is up for auction by the city.

This company is raising my payment by 400.00 stating that there was a shortfall because we didnt have insurance and taxes added into our loan when the took over our loan from Chase.  We have the affordable homes program and our loan was looked over by the attoney general because Chase had been giving us the run around for 1yr1/2.  I have all the orginal paper work and the goverenmt's affordable homes program HAS to have your insurance and taxes included into the payment.  They increased our payment by increasing our insurance and taxes, then tacked on another 2600.00 saying the is the short fall.  Well if you increased the insurance and taxes payout and I'm paying that increase every month how is it a short fall and you are then adding another 2600.00.  I checked with my taxes and insurance those things never did get increased I am fighting with them to take my payment back to where it was.  Add me to this class action if possible or direct me to someone here in the Indiana area!!

 I had a decently priced mortgage and received a letter with a 10 day notice that my mortgage was going up over $200 per month.  I called SPS to find out why and they said it was because of an escrow shortage that had happened 1 1/2 years ago when my insurance went up.  They claimed that they happened to review my account and found the shortage. Now I am struggling to pay an inflated mortgage which from my understanding is going to take more than 3 years to pay off this so called escrow shortage.  They need to do escrow reviews on a regular basis so that if there is a shortage it does not fall 1 1/2 years behind.  Not to mention, if they were on top of things, an escrow would never be 1 1/2 years behind in the first place!

My loan was sold to SPS from Chase.  I have two insurance claims and have been lied to on at least six occassions about being sent a check for repairs.  Just today I learned that they had cut and mailed a check to me on 12/24 and sent via FEDEX.  Now I learned that "they lost the check, numbers did not match . . " and they are redepositing the check into my escrow account. They will reorder and send the check.  REALLY??

 

Count me in for any class action activity.  I am clearly getting jerked around.

I too have a mortgage that originated with Country Wide, transferred to BOA, and is now with SPS. I was laid off for a short while in 2008 while with BOA, while just 3 weeks late was offered modification assistance. It sounded so appealing that I fell for it. The end result was an escrow was created that escalated with all kinds of ridiculously added expense, my house payment doubled, I was told to just pay what I could during review, and then after a 2 year struggle trying to pay the double charges was told I was not eligible and because I did as instructed and paid what I could I was 6 then 6 months behind. I borrowed from every possible source I could to get caught up and avoided foreclosure. I did still have a huge backwards escrow balance I had to pay off before my account could go back to the original payment with me paying my own insurance and property taxes.  In 2011 the mortgage was handed over to SPS. I had no knowledge of this companyso after struggling with BOA for years I had hopes I could pay the escrow off, get my credit straightened up, and get some real financing. I spoke with a SPS representative and was told the escrow would have to be paid off before it could be removed. I started paying it down  whenever my budget allowed. I got it down to a little over $1600. The balance amount I got was given to me from a SPS representative. I paid it, then called the next month to ask why there was still an escrow added to my payment. I was told I still owed an additional $63 on the escrow. I paid my monthly payment plus the $63. The next month there is still an additional escrow added to my payment. I callled again and was told I still had a escrow balance of $418. I asked where did it come from because my insurance and taxes were paid up for the year, and was told escrow had to be added monthly because i had a modified mortgage. I do not have a modified mortgage, I did try to get one in the past but was found inelligible. I took out a loan to pay off the escrow and attempt to get my payment back to the one I agreed to when I bought the house. I have financially struggled to keep myself afloat and keep my home since the house transferred to BOA and then to SPS. My credit has been ruined, I am now behind again because I cannot afford to pay an escrow off and simply pay a double escrow thats still tacked onto my payment, I am tired of trying for nothing. I contacted a realator and put my house up for sale yesterday but being I am behind and have already borrowed from every source trying to eliminate the escrow charges, I am afraid I may lose the house before I can sell and recover from this mess. My house is well worth the payment I agreed to and I make enough to afford it, but it is not worth what SPS is trying to bleed from me monthly,and nor can I afford that. If there is any Class action suits started against this company please contact me! I want in!

They bought my loan that I had for 14 months from BofA. My payments stayed the same for 3 months and the  they sent a letter stating I owed $3K in taxes so my payment went up $85 per month for 3 yr's. SPS has put my house in foreclosure after BofA sold them my loan in Nov 2012. SPS is incompetent, to put it mildly, with faulty & incorrect info given by their reps w almost every call. 3 times I've requested reinstatement quotes to bring my loan current. The reinstatement quotes expire 7 days from when you request it. SPS takes 3 -4 day to generate the quote, then they mail it. They include weekends, yes Sundays too, in the 7 day ticker. All three quotes have expired before they reach my mailbox. Salt Lake City postmark proves this. The other option they give you is to fax the quote. Who has a fax machine? With any means of delivery the quote still needs to be generated, which SPS says takes 3-4 days. This is part of the 7 day expiration they give for the quote. Most of the loss mitigation representative I speak with have to repeatedly "place me on hold for a moment" to ask their supervisors questions. Yet one rep said he doesn't have a supervisor and that I needed to talk to him. Almost all calls have lasted 30-45 mins with no customer resolutions. This company needs to be sued. They told us that we qualified for a program that would allow our past due amount to be added to the end of our notes if we set up 3 payments to automatically be withdrawn from our bank account. They sent us papers for loan modification and the first payment was withdrawn before we received the papers. We signed the papers and sent them back in. All three payments were withdrawn. We received a foreclosure notice a few days ago. My husband called them and they told him we didn't get the paper sent back quick enough and that we now don't qualify for loan modification. They took all three payments out of our acct. and also said if we went through this process they would lower out interest rate. They say that they are trying to help people keep their homes, but if that is so why would a small technicality that wasn't even mentioned on the phone keep you from the modification process. It is just a game they play! The automatic payments were made.

We've been dragged through the ringer with Countrywide, B of A and now this fraudulent Select Portfolio. Bank of America transferred our recently modified loan to SPS back in August. Which doesn't surprise me that B of A (Crooks) would start tranferring all of their liabilty after the AG National Mortgage Settlement was set into motion! Making a long story short, it's been a nightmare so far with this company. They don't offer any pricipal reductions, (such as what we should've been offered by B of A) or much of anything for that matter. They're trying to raise our modified payment, due to some bogus excuse about escrow falling short almost $2,000 dollars. The ONLY thing that's changed in our ecsrow is that our taxes are LESS. They're overcharging us. We've had them for 3 months and they came up with that much of a shortage?! Our taxes are included in our modified payment. This is just another one of their strategic tactics to induce foreclosure. These PIRATES MUST BE STOPPED!
