Payments are made monthly online on the 2nd Wed of the month. Repeatedly have asked them to change my due date to the 15th. They refuse. Mortgage was transferred from Chase to them and chase also refused to change my due date so if the payment comes in after the 10th it is marked late, I get late charges and my credit rating has dropped because of it. I can't even get a new car loan because of the credit rating even though this is my only Bill along with an online clothing account for a few hundred dollars and the usual utility bills. I have repeatedly asked them and they refuse. I would join the class action lawsuit if it us still ongoing. Please advise.

Thank you for your advice. Many years ago chase had reported one late payment. They never fixed this and contined to list onr laye payment. it has gone on since then ... sps had escalated that to read additional late payments...therefore when the payment gets posted after the 10th SPS is now listing them as additional late payments so the credit reports show many late payments. My crecit score has dropped because of this. They receive their payments online on the 2nd Wed of the month when I receive my check. Payments are made every month. My husband was murdered in 2011 which changed my financial pix and I had to make the mortg payts on the 2nd Wed. I went into heart failure shortly after. The mtg company just does not care if you have extenuating circumstances. Ps... I was late on the one payt I spoke of with Chase but paid my mtg down 80,000 with his ins money. That alone should have wiped out that late payt. Again, they don't care.

I am not affilated with your current, or past, mortgage servicer (SPS or Chase).  

However, I am very familiar with mortgage servicing.  Read your mortgage documents. The due dates are specified in writing in the documents you signed. Those due dates can't be changed from what you signed.

What is standard in the industry is for the late payments to be reported AFTER 30 days beyond the due date. Therefore, if your due date is on the first of the month, the late payments would not be reported unless you failed to make the payment 30 days after the first. The late payments are only reported to the CRA once you hit 30 days past due. There if they are reporting you late after 15 days, then you have recourse. But I find that would be very unlikely.

 If YOU don't like the consequences of YOU making late payments, then pay on time! It was YOU who agreed to the mortgage contract due date. It's up to YOU to manage YOUR finances to be able to pay on time! Grow up! That's the real world as opposed to the "lets change the due date game". Let me save you some effort. Don't bother writing back "you must work for them". I'll tell you ahead of time, I don't.
