September 11, 2006

It all started when I received a letter around mid December of 05 from RCI indicating that we are no longer an owner of a vacation interest at the Star Point Resort.

After receiving this letter, this is when I stepped to action and started calling to see what's up. Listed below are the December callings, not sure of exact dates but it all happened between 12/22 & 12/29.

Called RCI, they said a Y. Kenner canceled points and to call the Resort.

Called the Resort, they said to call Maintenance Billing because they think it may be Maintenance fee related.

Called Maintenance fees #, 1-800-519-2690, and they said to call Jockey Club.

Called Jockey Club (1-800-634-6649) and finally got Yvonne Kenner and found that my dues had not been paid for the previous year. I explained to her that I never received a bill. She says to call Tom Jay from Maintenance Billing.

Called Tom Jay, chatted and he will email me with the exact payment.

Tom says to call a guy named Joz at the Resort to see about re-instating the points

Called Joz and left a message.

January

1. Joz calls me back and indicates he will email Tom Jay (Maintenance Billing), and leave him a reminder to send me the bill and he (Joz) would check on re-instating the points.

2. Called Tom Jay back again, (still haven't received an email of bill). Finally got a chance to talk with him and found out he sent it, but to the wrong email address. Gave him the address again and received it on the 1/19/06.

3. Made the payment online on 1/26/06 and will give 30 days for it to post to the Jockey Club system.

March

1. 3/1, Called Yvonne because bill has cleared, but the points have not been re-instated, Why not? Found out she is off on Tuesday and Wednesdays.

2. 3/2, Got Yvonne, she says to call the Resort because they are the ones that can re-instated the points. Called the Star Point Resort, (702-699-5323), left message.

3. 3/6, No return call, left message again.

4. 3/8, Again no return call, finally someone answered the phone, I get Jessica, she says she will call RCI to see what she can find out, says she will call me Friday.

5. 3/16, No called received as of yet, so I call her back and she indicates she got a particular name from RCI as to who canceled my points. It was a Bogus name, so I pointed out to her that Yvonne Kenner at RCI canceled the points and all you have to do is call her and have her re-instate the points. Told her that Yvonne indicated to me, the last time we talked, that she would verify that I handled this matter in a very timely matter to get the dues paid up. Said she would call me back.

6. 3/20, No call back, so guess what? Yes, I'm getting a little angry now, so I call her back and she indicated to me that Yvonne was not in all week, (I don't believe her). But she says she will call me back, yeah right!

7. 3/28, Called Jessica, but get Amy. Amy says she was out at the moment, so I left a message for Jessica to call me back. I tried explaining the situation to Amy, but she pulled a Hogan Heroes Shultz (I know nothing). Also called Jockey Club for Yvonne, found out that Yvonne is on vacation this week. So I asked employee if Yvonne was out 2 weeks prior, (when Jessica said she was), and low and behold, Yvonne was not out that week. Now I feel like Magnum P.I. and I'm getting somewhere. Jessica straight up lied to me.

8. 3/29, Called Jessica again, whomever I talked to says Jessica is not in today.

9. 3/30, Called Jessica again, got Kim, says Jessica is on another line, so I left message with her, to have Jessica call me back.

10. 4/4, What's new, No fricking call back, (See why I'm pissed at this point). Well anyway, I find out that Jessica is out of the office today. Bee-otch doesn't work very much does she? I also talked with Amy and got the boss' name and she said it was Shaun, but didn't know how to spell his last name.

I left message for him to call.

Who are these people?

11. 4/10, Still no callback, At this point I have had enough, time to call PREPAIDLEGAL the Defenders of Justice. The ball's in your court and I sure hope we can do something about this

APRIL - MAY

1. 4/11, No callback from Shawn T., talked with Texas Lawyers file #1071740 and was referred to Las Vegas Lawyers.

2. 4/13, Talked with Las Vegas Lawyer Wenlee Jensen, case #228000. They will draft a letter after receiving my grievance information.

3. 5/3, Chatted with Wenlee Jensen, and she has received my information and will draft a letter to Star Point.

4. 5/29, finally received letter from the Real Estate Division of Las Vegas. Contacted Compliance dept. and talked with Alex. Tim Shane is handling my case. Found out they had sent something on 5/15/06 and they said they usually give 30 for a reply. I will check back in mid June.

JUNE

1. 6/19, Contacted Alex again and he has heard nothing. He will call again to try to find out what's up. Usually should have something in 24- 48 hours.

2. 6/22, No reply from Alex so I called again, he still has not heard anything. Later that afternoon, Alex called back indicating that Star Point has a letter and will be issuing it to my Lawyers.

3. 6/27, received letter from my Lawyers, response from Star Point was bullsh_t.

4. 6/30, wrote another letter back to Star Point, Mr. Muldoon.

JULY-AUGUST

1. 7/3, Delivered letter to Star Point based on the return receipt request.. Will give 30 days for a response, then contact Lawyer for further instructions.

2. 8/14, Called Lawyer for advise, and Lawyer indicated that I should try to sell it on Timeshare.com or quicksale.com. She also mentioned that I should file a complaint with the Real Estate Division.

3. 8/17, Talked with Alex (Real Estate Div) and he will talk w/Muldoon to see why there has been no response to my other letter.

4. 8/25, Called Alex back, still no response, but he has left 2 messages.

5. 8/29, Alex called me and left message to call their (Star Point) customer service number, 1-866-934-7827.

6. 8/31, called several times, line was always busy, 9/1, I finally get thru and low and behold, who do I get Fricking JESSICA. I asked for my points back and she said she would have to call me back.. Yeah right! Right back to square one.

Knowing that I would not get a callback, this total run-around I'm getting from Star Point shows that they are extremely un-professional. My guess they are Professional Scammers.

I have had enough, time to complain to the Real Estate Division.

7. 9/5, Started putting items together to send to the Real Estate Division as they requested.

In doing all of this, all I wanted was for them to re-instate the points they promised upon the initial sale when I first bought it. Now, after going through this, just to get the points back, I just plain do not ever want to do business with them again.

I WANT MY MONEY BACK!!!

As I see it for all the pain and suffering to put this together they will owe the follow:

1. All costs paid to them by me for the vacation resort

2. More to come

Personally, I think they need to be taken down.

STAR POINT - Las Vegas, Nv

#2Author of original report

Fri, January 12, 2007

I started my blitz campaign on October 30, 2006 by sending Star Point a letter letting them know that I had created a RipOff report about them and listed my demands to sever all ties with them. I indicated that I wanted my money back, and after 10 months of them ignoring me, re-instating the points at this point was out of the question. They missed the first deadline to respond, which was 11/2/06, so I did a mailing on 11/6/06 to the Las Vegas Real Estate division. That night, 11/06/06, I received a call from Jessica at Star Point (now she finally calls) and she indicated that they would deal with my situation through my Lawyer. I said OK. I called my PrePaidLegal Lawyer on 11/10 to discuss some items and I sent her a list of the RipOff reports that I had gathered from the RipOff.com site. We gave them until November 13, 2006, to respond. Well, they did respond on 11/13/06 calling and leaving a voice mail to let me know that my points had been re-instated. Whoop de do, I say TOO LITTLE, TOO LATE. My demand was to get my money back and sever all ties with this unprofessional company. I returned the call that night to Star Point and talked with Jessica and she indicated she did not leave the message, but it was probably from someone at the Jockey Club. So I called the Jockey Club and talked with Yvonne Kenner and she re-iterated that my points have been re-instated and to check the RCI site to make sure. On 11/16/06, I checked the RCI site and indeed the points were re-instated. Still not fully satisfied, I called my Lawyer and filled her in on what has transpired so far. We will still look to get my money back to sever all ties with this company. In chatting with my Lawyer, she indicated that we could try sending them a forfeiture letter that pertains to allowing them to have my Deed in Lieu of Foreclosure. I would not require any monies, so they would keep what they have received from me already, they could resell, and I could go on my merry way. The letter was sent out on or around 11/21/06 letting Star Point know what we are proposing. They were given instructions to contact me within 10 days of receiving the letter to negotiate. I will bet they will ignore this too so I will give them 30 days or so just to prove my point again, they will probably ignore our request. On 12/13/06, I received a call from a Collection agency where they received information that I have stopped paying. He said the item came across his desk in September. I explained to him my situation and that I was not going to give them another dime because of the way I had been treated. He explained his position, which I understand because he's trying to do his job, but StarPoint is playing hard ball. Indeed I signed a contract, but what I don't understand is why StarPoint would continually have me stay in bed with them when I clearly indicated that I want out, and have given them a reasonable way out for both of us. What kind of person would force someone to stay in bed with them?. A RAPIST, That's WHO. You can bet your sweet a*s, I'm not going down that easy. 12/18/06, I received a call from Monterey Financials, this is where our monthly payments were going and I was informed that I was behind in payments, well I knew that and in talking to my Lawyer, I found that I was contractually responsible, so I paid the balance in full. Around the same time, low and behold I get another letter from Mr. Muldoon, basically recapping the whole situation, and telling my Lawyer and me that I was making false statements and misrepresentations when it came to his company. I'm not sure why, but he did not even address the Deed in Lieu of Foreclosure, which is what our letter to him specifically asked about. He again may have been beating around the bush. Well anyway, I replied back with my thoughts letting him know that they were not false statements and they were developed from his company's actions and I called it like I saw it. At this point, a reply is on Mr. Muldoon to discuss an out for me, which he is not obligated to do. If he replies, (which I highly doubt), I'll let you know. I have made my point on STAR POINT and I would have you beware rather than make the same mistake I did. Maybe more to come, maybe not.we'll see!!!
