On Sept. 19th,2015 I had contracted with Sterling Construction and Home Remodeling LLC to install an asphalt driveway in my rental home in Cedar Lake Indiana. Time was the essence of the contract as I had a tenant moving in on the 3rd of October, the date that the contracted job was to be completed by. a $50.00 per day penalty was to be assessed if not completed by the 3rd. At that time I had entered into a separate contract for a new driveway in my personal home. Oct. 3rd had come and gone and no work had been started on the Cedar Lake driveway. I called Wayne Hermansen, the owner of Sterling Construction. He acted oblivious to the deal and my time constraints. He stated he would get back to
me. Silence from Sterling Construction continued for several more days although I had made several attemps to have this resolved. At this point I only wanted a refund on both jobs as Sterling was in breach of the contract. On or about Oct. 7th I received a call from the Cedar Lake building department stating they had 2 driveway permits for the same address in Cedar Lake, one from Sterling Construction, whom it turns out is not licensed to conduct work in Cedar Lake, and another from a company called Economy Paving. I had already fired Sterling Construction but had not hired a replacement contractor at that time. I asked Cedar Lake for a copy of Economy Paving's permit application and they complied. Wayne
Hermansen from Sterling Construction had contracted Economy paving without my knowledge for only half the job I had contracted with Sterling Construction. I was never told by Sterling's sales rep that Sterling was not licensed to conduct work in Cedar Lake Indiana. Nor was I told that Sterling Construction had planned to subcontract the job. Sterling Construction just wasn't licensed to do the work. The contract I signed With Sterling Construction included the removal of the existing driveway, install gravel then asphalt. The contract Wayne Hermansen from Sterling to Economy Paving stated to lay asphalt over the existing driveway. This was not my agreement. It would never had been discovered by me that the
original driveway was NOT removed before laying new asphalt as the home was vacant. It was only after the Cedar Lake permit department had called me that I learned of Sterlings seperate contract with Economy Paving. This conduct borderlines fraud by Sterling Construction on myself. I then demanded a full refund from Wayne Hermansen. He told me to come to his office for the refund. When I arrived I was told he spoke with his attorney and was advised not to efund any of my money. I immediately received a letter from his attorney stating Sterlings legal right to retain the profits from both jobs. I called his attorney and told him that I was in possession of Sterlings contract with Economy Paving proving
unethical buisiness practices. The conversation abruptly ended with Sterling's attorney hanging up on me. The second contracted driveway on my personal home was again subcontracted leaving out the replacement of the entire sidewalk. I contacted the BBB as well as filed suit. Do not contract with Sterling Construction and Home Remodeling LLC owned by Wayne Hermansen. He is far from ethical and had made me sue him due to his outragious conduct.
