Suntrust Mortgage adds a whole new meaning to the word FRAUD.
We know they don't actually have a mortgage on Liana & Rusty Bennetts project. I wish they'd stop pretending to everyone they ever did by remaining silent and letting assumptions rule. You have an adujustable rate note (IOU) that goes behind the interest of the construction mortgage lender/beneficiary!
Construction Loan Rider, Construction Allonge to the Note, Construction Mortgage, & Construction Loan Agreement & Default on all of them apparently don't mean anything legally according to this company and how they presented the info.to my attorneys.
This company has defaulted! DEFAULT! A contract for a deed and the seller has NOT defaulted.
Good luck foreclosing on a mortgage YOU DON'T HAVE!...isn't it illegal.....where's the written offer to settle on something we already have an interest in?
Thanks to the counsel at Stoel Rives, especially Sean Gay, Suntrust must be so proud to have twisted everything.
SunTrust better hope the Oregon Court of Appeals doesn't read the construction loan agreement and tie it to the construction loan rider and construction mortgage showing our real lien. Stoel Rives was kind enough to try and throw them off with the Notice of a Right to a Lien! They should have just settled with us when we offered to buy this property before the trial.........We just want paid and it has been 5 years and the house sits unfinished. The Bennett's are in a 5 year Chapter 13 and have surrendered the property and related remaining funds.
The Bennetts became friends with a wealthy 85 year old who lost her husband where Liana Bennett works as the bookkeeper (Yes, of course it's fishy) Liana filed bankruptcy and asked the little old lady if she could place her horse on the womans property. Well, then she started visiting, borrowing money and now two years later Liana and her husband Rusty Bennett have talked the lady into buying a home right across from my and my family for over $368,000. The Bennetts currently rent the property from her for below-market value......Life is not so sweet......
