This is a letter that will be sent to the Department of labor, the Governor of NY, The better Business Bureau, The Secretary of state,   DOT, The Unemployment Office, Department of motor Vehicles, Superior Truck Lines, JB Hunt corporate office, Various web sites strictly holding information and other reports regarding DAC information, my attorney, press and media who express interest, as well as any further offices and organizations I find to be of interest in this matter .

 

  My name is Doug. I have lived my whole life in NY and up to recently, held employment with companies and remained self sufficient. After a ten year history with an organization, my service was ended and I found myself in need of a career that would fulfill my needs for the duration of my employment years. At my age and todays economy, my choices were limited. I chose to pursue a career as a truck driver and put myself into a school and graduated with very high scores and a promise of a long rewarding career.

  After I graduated, I started with a company out of Des Moines , IA. That was OK except I was NEVER home and being new, I was not getting prime loads. That caused me to come home with $250 paychecks and almost cost me my relationship and made it impossible to pay my debts. So from there I joined a company that was local to my home and became a local driver. The name of the company is Superior Truck Lines in Port Gibson , NY .

  Here is where I get more to the point of this letter.

When I first joined this company, I was offered either a local driving position or a long haul position. I chose a local position.

  I stayed local going anywhere from Buffalo , NY to Syracuse , NY as well as distances beyond. Being a local driver, I know there are legal limits to the radius and hours I should drive. They would dispatch me well over the mile radiuses as well as over my legal hours. They even made local drivers maintain log books on top of punching a clock which will verify. I never really enjoyed working 14, 16, or 20 hour days, but completed my runs any way. I let this happen and just assumed they would scratch my back when I needed it.

While I was with this company, I began looking for another driving job because I was not meeting my financial obligations. Finally I was contacted by JB Hunt in Chicago , IL .

JB Hunt contacted me on 09/03/09 and told me they needed me to be in Chicago , IL   by 09/14/09 to start orientation at 6am . I accepted and gave notice to Superior Truck Lines that I was leaving on 09/11/09 in writing. They accepted 2 copies. One to Safety and one to dispatch. But then I got notice that my girl friend had MAJOR surgery on her leg and told dispatch on the phone that I had to leave after that days run because she herself lives in IL. The dispatcher had nothing to say but instead just asked what my status was at my delivery in which I replied.

  When I returned to dispatch later that evening, I wrote a quick letter saying good bye to everyone and left it for all to see, punched the time clock and removed the last of my personal effects from my truck number 300.

On my way to Chicago on 09/11/09 , I received a call from the recruiter from JB Hunt that I had been talking to all along (Michelle Cummings) and she told me that she still hasnt received the DAC report from Superior Truck Lines. I reminded her that I already signed and faxed the authorization to her to view that report and that I still have the receipt of a successful fax with me. I also reminded her that I paid and received a copy of my MVR and faxed that as well and that it was totally clean. I had NO ACCIDENTS, NO DWI, NO MOVING VIOLATIONSNOTHING.

Here is a key point

I also told her that Superior Truck Lines has a reputation for messing with DAC records more than once. This was information I found out on line on the internet as well as with drivers just fired or drivers still working with Superior Truck Lines.

  Miss Cummings assured me once again that there was no problems and everything will be fine and wished me luck with JB Hunt and even offered me her cell number.

Now I have left my state, my home, my family and kids and moved to IL on the PROMISE of a job with JB Hunt.

I arrived at my orientation every day starting on 09/14/09 at 6am . I was meeting or exceeding expectations in my physicals as well as in my driving skills and was told I was doing well by my instructors.

On my LAST day, Wednesday 09/16/09 , I received a message from the JB Hunt investigator that they still couldnt get Superior Truck Lines to send my DAC record to them. I once again informed the investigator in a semi joking manor that its probably because Superior has to hurry up and fabricate something before they can send it

Well how true that became. I was almost through with one of the last requirement on my last day of orientation..the DOT physical. When the examiner re entered my waiting room, he told me that I had to go see the Safety Department and that it generally isnt a good thing. I did, and was told to call the investigator named Janet, and was informed that I was being let go from JB Hunt. When I asked why? She simply stated that I failed to tell her about the multiple accidents on my DAC report. When I asked her what she was talking about, she told me..superior put on my report that I side swiped a car and also hit a stationary object on two separate occasions.

I told her this was not true, but she stated that "it was filed by Superior and that if I had any questions, to contact them but that she was sorry, JB Hunt had to release me from service." I then went to the instructor and informed him and was given a phone number to call and rebuttal the accusations and to have my rebuttal also placed into my DAC report.

I then left the JB Hunt terminal in Chicago, IL and then had to go back to where I am sleeping on a friends couch and inform them that I am now unemployed and had no way to vacate their home due to choices made by Superior Truck Lines to slander me and trash my DAC record as well as JB Hunts decision to believe them.

I now ask these serious questions and hope I get the appropriate people to start thinking of the power given to employers over those who hold a CDL license and who ruin homes and take away income and livelihood.

 

1: Is this DAC data base held over CDL drivers heads a monitored database by anyone with authority or any government agency?

 

2: If monitored, do the entries in there have to hold LEGAL merit? (Ticketable or legally citationed and verifiable )

 

3: What person, department, organization(s) do so? How often?

 

4: Why is it any company can access this record and put anything in there, but the actual CDL driver can not?

 

5: What are the LEGAL criteria to be able to place anything in a drivers DAC record?

 

6: What are the types of information allowable in the DAC record?   Verifiable facts? Or even opinions by employers?

 

7: If accused of any accidents by an employer, wouldnt a ticket, citation, or a police report have to be filed along with the location, date, and time, and vehicles involved of the alleged accident as well as the street intersections or address be filed as well?

 

8: If a driver not only has 1, but accused of multiple accidents, wouldnt a drug test be required? If so, wouldnt there be record of the tests?

 

9: What recourse does a company face for willingly placing a false entry into a drivers record?

 

I could go on and on, but my intent is to seek satisfaction from Superior Truck Lines   either financially, or reputation, or other means for having my career and income taken away from me by a company upset by my leaving. If I was such a bad driver, why would a company keep me in service risking equipment damage, property damage, or even risking lives? Why not re evaluate me, re train me, or counsel me on my driving abilities? To me, this was a CLEAR issue of a company upset that a key local driver was leaving for another company and out of spite, removed any ability to successfully find employment with any other company that requires a CDL license by filing false information on my DAC report without filing any true and verifiable data to reinforce their accusations .

The power that a company has for those with a CDL is unreal, unjust, and intolerable!

Thank you for your statements on this public media instead of contacting the company directly to resolve your issues. I will attempt to resolve your allegations in a mature manner.

Yes, we do require our local drivers to maintain a Driver’s Daily Log along with punching a time clock. Why? There is a simple answer – because we can.

You also state that you gave 2 weeks’ notice. Yes, you did and that was very respectable. Then you go on to state that you notified us via telephone regarding some “major surgery” on your girlfriends leg. That is where things become incorrect. The facts are – on 9/10/09 – you waited until after office staff had left for the day, then left a note in the shop for the staff. An interesting note I must state but none the less – a note that became part of your permanent record. You were given a trip envelope on 9/10/09 for your 9/11/09 work in which you removed your paycheck from and then did not do the 9/11/09 work. You did NOT call anyone on the afterhour’s list to notify them of your intentions to quit on 9/10/09. You let the company and our customer down. Not the work ethic that you portray of yourself in your statement on this public media. We have drivers that have unexpected family emergency that we accommodate – all they have to do is call us (during or after normal office hours)! By the way – this is where the “quit under dispatch” comes in – work ethics dictate that had you called us on 9/10/09 and notified us of your intentions – that label would have been avoided.

Let’s move onto your next major allegation – your DAC report. Which by the way, doesn’t exist from Superior Truck Lines, Inc. You are confusing a DAC report with previous employment verification. This is a common rookie mistake. A DAC report is a database that many companies use. We don’t supply information regarding an employee to the DAC  system until the END of a driver’s employment. More often than not, we supply previous employment verifications when requested by prospective employers. The prospective company in this scenario is JB Hunt – in which they sent over previous employment verification. Per Federal Motor Carrier Safety Administration regulations, we have 30 days from the date the employment verification is sent to us to respond back to the requesting employer. We, as a motor carrier are regulated on the information that we MUST provide to the requesting employer.  Your “key point” is laughable – show me the DAC report that we allegedly submitted against you.

Now to answer your questions:

  1. A DAC database is basically a way for employers to check the safety of CDL drivers to continue to protect the motoring public. It list factual information as it is regulated as well.

  2.  Entries have to hold legal merit. There are categories that separate DOT reportable from non-(DOT)reportable categories.

  3. You would need to contact DAC for this information. I am sure they have a whole department that takes care of this directly.

  4. The CDL driver is also allowed to make rebuttal statements on their DAC report to explain information provided by their employer on their DAC. Keep in mind – employers are careful to only provided DOCUMENTED, factual information and can rebut your statement with completed and submitted driver statements.

  5. Please see the DAC site. They provide a wealth of information there.

  6. Please see the DAC site. I am not sure on what other companies do – I can only tell you they we do not respond to any question that gives opinions on any driver. We stick to FACTUAL INFORMATION ONLY.

  7. Accidents can be DOT reportable or non-reportable. There are specific criteria to make an accident DOT reportable. You should familiarize yourself with that before making such statement. You should also be aware that any damage that you create with company equipment that is under your control, regardless of the severity, is still an accident. Even if it does NOT meet the DOT Reportable criteria, it is still an accident you created. Why should the company withhold that information? If you were hiring a driver, wouldn’t you want to know what their safety record is before putting them behind the wheel?

  8. Drug tests are also federally regulated. Not all accidents incurred require the driver to be drug tested nor do all accidents require police investigation.  Please familiarize yourself with the DOT regulation on post accident drug testing.

  9. The recourse a driver has is to contact the company directly and/or submit a rebuttal.

I realize that the statement you made on this public media was a while ago and I sincerely hope that you have gained the experience needed to better understand the decisions you made. You made our company out to be the “bad guy” when we simply stated the facts regarding your safety/work history.
