I brought my 2 children, Sophia, age 4 and Tiffany age 6 to attend Swift Martial Arts summer camp for two weeks, from August 3, 2009 through August 14, 2009.  At the end of the first day, August 3, 2009 we were advised that several children attending the camp were diagnosed with the virus HINI (Swine Flu).  We were also advised that the facility would be closed and the health department would be contacted.  We were told not to bring back our children until we had a letter from their doctor that they were not sick.  My children began to experience diarrhea and vomiting on Tuesday, August 4, 2009.  I contacted their Pediatrician, Dr. Siblesz located at:

who advised us to immediately administer TamiFlu to our children. In addition, Tiffany, my six year old also contracted an unknown rash throughout her upper body.  I was unable to work for four days as I nursed my girls back to health.  On Wednesday, August 5, 2009, we were contacted by Henry from the Miami-Dade County Health Department on Infectious Disease Control.  The phone call was to inquire what had happened to our children and what their diagnosis and medication was.  I spoke to Ruth Casanova, the general manager, on Monday, August 10, 2009, and requested a refund in the amount of $610.  This payment was for prepaying summer camp services for two weeks in which Swift Martial Arts would care for our children.  She refused to refund any of our money.  Ms. Casanova was extremely hostile and went on to allege that there was no HINI virus outbreak to begin with at her business.  She went on to say that my children probably contracted the disease from another location and brought it into her place of business.  I was mortified and shocked at her false statements.  On August 11, 2009, I contacted the Miami-Dade County Health Department on Infectious Disease Control and spoke to Ana regarding this matter.  Ana was not allowed to disclose any information on this case, but offered that the Swift Martial Arts was not handling this matter honestly and respectfully.

 

 

I have done the following:

 

1.  Sent certified letter to the owner of Swift Martial Arts Corp, David A. Ledezma, President on August 11, 2009.

2.  Filed a complaint with the Better Business Bureau, complaint number 8515279 on August 11, 2009.

3.  Filed a complaint with the Miami-Dade Consumer Mediation Center, Case number 2009-760820 on August 11, 2009.

4.  Sent a fax to Senator Alex Diaz de la Portilla, Miami-Dade County Senator, on August 11, 2009.

5.  Sent an email to the media, Help Me Howard on August 13, 2009.

 

Swift Martial Arts should not be allowed to take $610 from our family when they have not rendered any services.  The one day of service resulted in both my children contacting an infectious disease.  My children were terrified to go back.  And as a mother I could not rightfully place my children back in such a facility.  As of today, Tiffanys rash on her upper body has not gone away.  Swift Martial Arts should not be permitted to conduct business in such a negligent manner.
